    Talking OC'ing an empty holster AKA , provoking the bear for sport

    So since Im a reluctant prisoner of the Peoples Socialist Republic for another 6 to 8 months And in light of the recently passed " One Gun a Month " Bill by King Corzine and his merry band of jesters , I've decided its time to push back , publicly ! Researched the Disordely Conduct Law ( doesnt apply , although Im sure one of the Stazi will eventually make the charge ) Im not worried , as not only does DC NOT apply , its not even part of the NJ Criminal Code , its a municipal " offense " . Got my digital micro recorder all set up , keep a copy of the DC " offense " language and Evan Nappens Book on NJ Gun and Weapon Law with me in my truck at all times . And have started wearing my conspicuously EMPTY holster in plain view.


    I was really pushing today , going to the parade in the AM , then going to the park for the local fireworks show , probably easily 1,000 people and lots of Cops . Intentionally drew attention with my Culpeper Flag set up right next to our chairs ( see this thread for pics http://forum.pafoa.org/lounge-108/64...eper-flag.html)

    Also had a bunch of lit made up at Staples, some of my personal writings and observations about whats wrong , lots of quotes from the Founders , legitmate stats on Carry , violent crime , crimes prevented by armed citizens , references to ATF , FBI UCF's and DOJ/NIJ studies , etc .

    Before we left I had discussed with the wife what might happen , I knew DC was a misdemeanor and even if they hauled me in and charged me it would be nothing more then a ticket and release , so I made sure she had her set of keys for my truck . Also had a discussion with our youngest , making sure that she understood as best she could at almost 5 that Daddy was doing things , taking a stand and fighting for whats right , so that hopefully she wouldnt have to someday when she was all grown up . Explained to her that if she was ever in trouble or someone was trying to hurt her or she needed help that she should ALWAYS call , run to , or find a Policeman , as they are there to help . But that they might want to talk to me about what I was doing because they might not understand and mistake me for a bad guy . Told her that I might have to talk to the police , maybe even take a ride with them to explain things , but that they werent going to hurt me , I wasnt going to leave , and her and mommy would be able to pick me up at the policeman's office if it came to that .

    The last thing I needed with what I was trying to provoke was a hysterical 5 year old , especially with Steph being pregnant to boot . She seemed to understand everything really well and be totally ok with the potential outcome ( she's a bright kid ! after all Im her Daddy )

    Anyway , I walked all around the damn park , took her to get ice cream before the show , standing in line for almost 45 mins ! Walked past gaggles of cops , and the end result ???????????









    A big FAT ZILCH !!!! NO ONE said a damn thing or even batted an eye !
    Truth be told , I dont think ANYONE even saw the holster , and this was broad daylight ! I sure didnt make any effort to hide it or shield my strongside from anyone's view . If any of the cops saw it , they didnt even so much as give me the hairy eyeball .

    So despite all my prep work , and psyching myself up for a confrontation , nothing happened . I MUST be doing something wrong

    Dont these guys know that my empty holster simply must be RAS of a crime ??

    Whenever I have to go into the PRNJ I wear an empty holster to protest the nonsense going on there and as you saw today no one notices, I guess it's like the 'kids and women running away screaming' bullshit they tell us over here ... never happens.

    Some of us in PA are behind you people stuck in NJ all the way! Keep up the good fight!

    To be honest, I might have a hard time identifying some holsters as being specifically for a firearm if I saw them on a belt empty. I imagine that people who don't own, carry, or see guns regularly would have even more trouble.

    What would be the legal ramifications of carrying a blue gun?

    Well.... If you really want to make it obvious..... you might try using a Full Flap Holster....


    Because it is not OPEN, they will want to know if it REALLY IS EMPTY..... and it's obvious that it's a gun holster and not for a cell-phone or whatever.....

    Of course, you could fill it with Lollipops and hand them out to the LEOs who ask about the holster.....

    I hear what your saying about maybe not instantly recognizing an empty holster for what it is . And with certain types/styles I'll agree your probably right . In MY case , I kinda doubt it though , as its a Kydex Belt Slide formed for a Taurus PT 92 that I once had , so the " silohouette " of the gun is molded right into the holster and fairly ease to discern , plus its also got a pretty hi riding and obvious thumb break retention so ............................. Im more chalking it up to the blissful ignorance of the sheep.

    As far as a training gun ? Dunno , might think about it . Now if I put my HK USP Compact Airsoft in a holster , the outcome is quite predictable , me face down on the pavement with a knee in my back comes to mind .

    I will say this about the idea of a " blue gun " . Im certainly no legal expert ( more a gifted amatuer ) but I'd be concerned , with the ready availability of an almost endless array of " Gun Kote " colors on the market , the local constabulary just might be able to wiggle out of a false arrest , illegal search and suppression of First Ammendment Rights suit by claiming they thought the " training gun " was a real gun painted blue .

    For now and the foreseeable future , Im more then likely going to just stick with the empty holster and see where it leads .
