Buy in PA - Transfer to NJ????

Sorry if this is a really stupid question but I need some advice.

I am a PA resident and I own several handguns and a shotgun. I also have a Conceal Carry permit.

About a month ago I drove to Fort Dix, NJ to shoot with a nephew of mine who is a Jersey resident. He brought along his father-in-law and his brother-in-law. They were all shooting long guns but really enjoyed firing several 357 magnums that I brought with me.

Now I get a call from the nephew who asks if I could purchase three 357's in PA and then transfer them to the three NJ residents! I don't think that would be legal but I do not know for sure.

I suppose if I owned a handgun that someone in NJ was interested in buying in a private sale, there should be a way to do so, but something about his proposal doesn't sit well wtih me.

I should say that the three individuals are each law abiding family men so it's not a situation where anything illegal is being contemplated.

So that's the deal. Any and all advice would be certainly appreciated.

Well I believe they need to get a pistol permit card from their county or local government and then they can start the purchase process. You might need to have your FFL ship to their FFL in dirty nasty stinky disgusting orange colored women jersey.

BTW, what doesnt sit right with you about this purchase if you believe that they are good people and not looking to do anything illegal?

My advice is don't go anywhere near that cesspool state with any guns, hollow-point bullets, or thoughts about defending yourself. I'm forced to go to that craphole at least once a month, and pretty much have to clean out the car before I go. I've read the horror stories of people getting caught with a handgun and now doing time. Be careful.

As far as transferring firearms, that's trouble I wouldn't even think of borrowing.

ABSOLUTELY POSITIVELY DO NOT DO THIS !!!!!


ALL NJ residents MUST have a Firearms ID Card in order to purchase or legally possess handguns , other then during a temporary transfer situation , such as at the shooting range when you described letting them try it , and even thats thin ice .

Number 1 , you would HAVE to have the pistols transferred via a NJ based FFL , and he wouldnt release them to your family members without seeing their FID Cards .

Number 2 , if you bought them in PA and did a private sale and were caught , or found out later , you WILL have the book fired at you and spend a significant portion of your future incarcerated as a firearms trafficker !

The Peoples Socialist Republic of NJ HATES GUNS and ANYONE that wants one . They will make an example of ANYONE , even in the most innocent of circumstances . PLEASE , PLEASE tell your family members you simply cant do anything other then help them move outta New Germany !

And mods , since PA shares the border , and these type of questions come up weekly , can we please consider making NJ Title 39 Statutes a sticky ???!??!

The handguns (assuming that you do not mean 357 carbines) would have to go to an FFL in NJ. To pick the handguns up from the FFL the NJ residents would need to get 3 seperate Permit To Puchase A Handgun permits, one for each handgun.
It would be much simpler for them to go to an FFL in NJ and have him/her order what guns they want, and get the proper permits and buy directly from the FFL.

Any idea why? Is this something that NJSP commissioner codified in the Admin Code because its not supported by state statue. I know there has been some really weird NJAC entries, like the one concerning consignment sales, but I'm not aware of a FID requirement for handguns.

2C:58-3 Purchase of firearms.

a.Permit to purchase a handgun. No person shall sell, give, transfer, assign or otherwise dispose of, nor receive, purchase, or otherwise acquire a handgun unless the purchaser, assignee, donee, receiver or holder is licensed as a dealer under this chapter or has first secured a permit to purchase a handgun as provided by this section.

b.Firearms purchaser identification card. No person shall sell, give, transfer, assign or otherwise dispose of nor receive, purchase or otherwise acquire an antique cannon or a rifle or shotgun, other than an antique rifle or shotgun, unless the purchaser, assignee, donee, receiver or holder is licensed as a dealer under this chapter or possesses a valid firearms purchaser identification card, and first exhibits said card to the seller, donor, transferor or assignor, and unless the purchaser, assignee, donee, receiver or holder signs a written certification, on a form prescribed by the superintendent, which shall indicate that he presently complies with the requirements of subsection c. of this section and shall contain his name, address and firearms purchaser identification card number or dealer's registration number. The said certification shall be retained by the seller, as provided in section 2C:58-2a., or, in the case of a person who is not a dealer, it may be filed with the chief of police of the municipality in which he resides or with the superintendent.

You are looking at SERIOUS FELONIES.

Not only is it in violation of NJ 2C:58-3 (previously posted) but its also a violation of FEDERAL LAW unless you go through an NJ FFL.

18 USC §922(a)(5)

(a) It shall be unlawful—
(5)for any person (other than a licensed importer, licensed manufacturer, licensed dealer, or licensed collector) to transfer, sell, trade, give, transport, or deliver any firearm to any person (other than a licensed importer, licensed manufacturer, licensed dealer, or licensed collector) who the transferor knows or has reasonable cause to believe does not reside in (or if the person is a corporation or other business entity, does not maintain a place of business in) the State in which the transferor resides; except that this paragraph shall not apply to
(A) the transfer, transportation, or delivery of a firearm made to carry out a bequest of a firearm to, or an acquisition by intestate succession of a firearm by, a person who is permitted to acquire or possess a firearm under the laws of the State of his residence, and
(B) the loan or rental of a firearm to any person for temporary use for lawful sporting purposes;

If your convicted on either the state or Fed charge you are a prohibited person, ie you cannot touch a firearm anywhere in the US for the rest of your life. Tell your nephew and cohorts to get themselves to the chief of police, get purchase permits, and buy from an FFL.
