Default HB 1292 - Changes to Licensing (LTCF)

If I read this correctly, this requires the Sheriff to provide a 30 day notice re: revocation of LTCF under the "good repute" clause and the license holder has a right to an automatic court hearing, (but license holder must respond to the notice to revoke).

I deem this one worthy of our support.

    PRINTER'S NO. 2029
    THE GENERAL ASSEMBLY OF PENNSYLVANIA
HOUSE BILL No. 1292 Session of 2009

    JUNE 8, 2009
REFERRED TO COMMITTEE ON JUDICIARY, JUNE 8, 2009
    AN ACT

1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, further providing for licenses.
3 The General Assembly of the Commonwealth of Pennsylvania
    4 hereby enacts as follows:
5 Section 1. Section 6109(i) of Title 18 of the Pennsylvania
6 Consolidated Statutes is amended to read:
    7 § 6109. Licenses.
    8 * * *
9 (i) Revocation.--[A license to carry firearms may be revoked
10 by the issuing authority for good cause. A]
11 (1) Except as provided under paragraph (2), a license to
12 carry firearms shall be revoked by the issuing authority for
13 any reason stated in subsection (e)(1) which occurs during
14 the term of the permit. Notice of revocation shall be in
15 writing and shall state the specific reason for revocation.
16 Notice shall be sent by certified mail to the individual
    --------------------------------------------------------------------------------
1 whose license is revoked, and, at that time, notice shall
2 also be provided to the Pennsylvania State Police by
3 electronic means, including e-mail or facsimile transmission,
4 that the license is no longer valid. An individual whose
5 license is revoked shall surrender the license to the issuing
6 authority within five days of receipt of the notice. An
7 individual whose license is revoked may appeal to the court
8 of common pleas for the judicial district in which the
9 individual resides. An individual who violates this section
    10 commits a summary offense.
11 (2) If a revocation of a license to carry firearms is
12 based on subsection (e)(1)(i) or for good cause not otherwise
13 specifically enumerated under subsection (e)(1), the issuing
14 authority shall provide the licensee notice via certified
15 mail of intent to revoke the license. The licensee shall have
16 a right to an evidentiary hearing before the court of common
17 pleas for the judicial district in which the individual
18 resides prior to the revocation. If the licensee fails to
19 respond to a notice of intention to revoke within 30 days,
20 the issuing authority may revoke the license and the
21 individual shall be deemed to have waived the right to appeal
    22 the revocation.

24 Section 2. This act shall take effect in 90 days.

IMO, this is absolutely a BIG step i the right direction.

The sheriff will now have to consider that his actions will automatically be subject to COURT REVIEW if the revokee so chooses. And since it is automatic upon request and free, you can bet your ass that the decision will be challenged by many, particularly if it is a bogus revocation.

    This is LONG overdue.

VERY big step in the right direction. If we get this passed, the big thing to keep in mind is keep your address current with the issuing authority....

Hmmm, noticed that on the first line 14 the license is referred to as a permit.

AHH yes. Very observant of you! But that is a portion that is in the existing law.

Text that is to be removed from the existing law is bounded [thus], text that is to be added is underlined.

Thanks also for your mail to your representive in support of this bill.

I also suggest that occasionally *we* send letters of thanks to those legislators supporting us. Or at least if one of the sponsors is your representative, saying thank you.

As most of you know, I usually hate any new legislation. However, I like this bill!

I am composing an email to my rep as soon as I finish here.
