    Question Q about gun transfer.

    When selling private. is it legal to sell a firearm & just do a bill of sale ???

    If it's a rifle or shotgun, yes. Pistol transfers must go through a FFL.

    Within Pa. it is lawful to sell a long gun (non NFA) privately. No paperwork of any kind is needed. You must abide by the laws in that the buyer must be:
    1) A Pa. Resident
    2) 18 or older
    3) Not *known by you* to be prohibited from owning firearms.

    Some people feel better about a bill of sale. Not to re-hash that old debate (do a search ) but I find limited to no utility in it as any kind of legal protection.

    Generally, handguns must be transferred at/by an FFL or sheriff per 18Pa.C.S.6111 Exceptions include transfers between spouses, parents/children and grandparent/grandchild. Those require no paperwork.

    Unless the participants are exempted per 18Pa.C.S.6111(c)

    A bill of sale for anything is always a good thing. Cars, cattle, horse, guns. If he later claims that you stole it from him, you have a document signed by him transferring title.

    Or if it turns out to have been used in a crime and you can show that you didn't own the gun until after the crime was committed, that's also good.

    As a seller, getting documentation is also good because an ATF trace might lead the po-lease right to your door and they might not buy the old, "I done sold it last month" line. So if you have a copy of the buyer's ID and his signature, you should be in good shape.

    I'm not a lawyer but this is what my lawyer told me about 25 years ago.

    As long as he is a resident and not known by you to be "prohibited" by Pa. or fed law then you can cash-n-carry.

    If I am reading the information correctly, if my son purchased a handgun in Virginia ( a resident of that commonwealth) he could give it to me as a gift and I would not have to register it in Pa.

    I told him to write up a bill of sale with the ser. # & his drivers lic # & address.
