    Yes it depends on the state and each has its own laws. BUT! To be LEGAL BOTH the BUYER and SELLER must be residents of the state were the sale is taking place! Otherwise a handgun MUST go to a FFL in the Seller's state to a FFL in the Buyers and the buyer must file a 4473 and undergo a background check to receive the piece. in the case of a long gun if the Seller is an FFL he may only sell if the out of state buyer meets federal requirements and the long gun being purchased is legal in the buyers state.
    Please correct me if I have stated anything incorrectly.

    They had no req for BCG for non FFL sales. Asshole got their wish now everything has to have a BCG in VA now.

    One minor correction:

    If buyer and seller live in separate states, seller can (if legal to possess in buyer's state) take handgun directly to an FFL in buyer's state and conduct the transfer to the buyer via the FFL there.

    There is no legal requirement to also involve an FFL in the seller's state if they all can and are willing to meet up in person to conduct the transfer at an FFL in the buyer's state.
