Driving thru school zones ccw
This might have been asked before and I apologize for asking. I regularly drive thru school zones (roads not on property) and am a CCW holder. If I were to get stopped by LEO am I breaking any laws by driving thru them (again public roads)?
A buddy argued with me about it and said I am breaking since its marked school zone? How is that avoidable? People use roads every day?
Thanks

Re: Driving thru school zones ccw
If you have a LTCF you are exempt of the federal 1000ft law.
PA's version only regulates being on the actual property thereof. While certain clauses of PA's version hasn't been settled, if you are called to pull over - I'd do my best pull over somewhere where you have good reason to believe it isn't school grounds.
Also, those marked "School Zone" things - those are meant as a courtesy to warn drivers, and to let you know that certain speeding restrictions apply. Penalties are harsher in school and construction zones than normal areas..RIP: SFN, 1861, twoeggsup, Lambo, jamesjo, JayBell, 32 Magnum, Pro2A, mrwildroot, dregan, Frenchy, Fragger, ungawa, Mtn Jack, Grapeshot, R.W.J., PennsyPlinker, Statkowski, Deanimator, roland, aubie515

Re: Driving thru school zones ccw
Also, there is no such thing as CCW in Pennsylvania. There is Carrying Concealed, which requires an LTCF, there is Open Carry, which requires no LTCF (except in Philadelphia), and there is carrying in a vehicle, which does require an LTCF.
In (or on) a vehicle, it does not matter how you are carrying the firearm (it could be taped to your forehead). Just the mere fact that you have it in the vehicle is what requires an LTCF.
Also, as stated, the LTCF exempts you from the Federal school zone restriction, but Pennsylvania has no such similar restriction. Your buddy is misinformed. Rather than you defend such statements, next time have your buddy show you what the law states.

In PA this is true, as the weapon is specific to a firearm for purposes designated for concealed carry.

Re: Driving thru school zones ccw
I go over the Federal GFSZA (Gun Free School Zone Act) every year with my guys and have talked about this with two crime watch groups.
With a license to carry (PA) which INCLUDES a background check as part of the process, you are NOT in violation of the GFSZA. The GFZSA is basically a 1,000' bubble around school property. You must have the license issued by the state in which the school is located. We are talking about carrying a loaded firearm (handgun) on your person.
As far as PA law goes, they only address school property. There is no "bubble" or school zone, only school property.

Re: Driving thru school zones ccw
What about the "conveyance" bubble if a student is in the vehicle too?
Emphasis added by me:
§ 912. Possession of weapon on school property.
(a) Definition.--Notwithstanding the definition of "weapon"
in section 907 (relating to possessing instruments of crime),
"weapon" for purposes of this section shall include but not be
limited to any knife, cutting instrument, cutting tool, nun-
chuck stick, firearm, shotgun, rifle and any other tool,
instrument or implement capable of inflicting serious bodily
injury.
(b) Offense defined.--A person commits a misdemeanor of the
first degree if he possesses a weapon in the buildings of, on
the grounds of, or in any conveyance providing transportation to
or from any elementary or secondary publicly-funded educational
institution, any elementary or secondary private school licensed
by the Department of Education or any elementary or secondary
parochial school.
(c) Defense.--It shall be a defense that the weapon is
possessed and used in conjunction with a lawful supervised
school activity or course or is possessed for other lawful
purpose.

Re: Driving thru school zones ccw
Thanks guys. I actually meant LTCF sorry about that. I figured so but wanted to check with you guys. Sometimes I panic when dropping my son off at school if I have it with me so I leave it at home for the drop off. Kinda a pain but I don't want any chances of any issues. I read about a guy who got stopped either dropping his son off or picking him up, not sure which one. He went thru heck for it and he never left his vehicle.
I appreciate the insight and will inform my buddy to read up more as I will as well.
I feel if you have an LTCF you should be able to carry anywhere but who am I to make the rules. LOL
