I need some help with this one. It is SB 09, here's some of the information. Note this bill has already been read twice and should soon receive a final vote. My comments and questions are shown in blue below.

AN ACT

1 Requiring identification of lawful presence in the United States
2 as a prerequisite to the receipt of public benefits.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Short title.
6 This act shall be known and may be cited as the Proof of
7 Citizenship for Receipt of Public Benefits Act.
Sounds like they mean business doesn't it? Under definitions we find:

"Public benefits."

16 (1) Any of the following:
1 (i) A grant, contract or loan provided by an agency
2 of the Commonwealth or local government.
3 (ii) Any welfare, health, disability, public or
4 assisted housing, postsecondary education, food
5 assistance, unemployment benefit or any other similar
6 benefit for which payments or assistance are provided to
7 an individual, household or family eligibility unit by an
8 agency of the Commonwealth or local government.

Then we get to the meat and it's here that I have a couple problems

14 Section 3. Identification required.
15 (a) General rule.--A person who applies directly to an
16 agency for public benefits shall:
17 (1) Provide, in person, by mail or by electronic means,
18 one of the following forms of identification to the agency:
19 (i) a valid driver's license or identification card
20 issued by the Department of Transportation;
I searched Title 75 under the sections regarding driver's licenses and could find nothing that either allowed or disallowed illegal aliens from obtaining a license, and (we all no that if an act is not disallowed it's allowed) nor could I find anything that required an individual to produce any form of citizenship documentation. Did I miss it? Does anyone know if there is a restriction on Illegal Aliens obtaining driver's licenses?
21 (ii) a valid identification card issued by any other
22 agency of the Commonwealth;
23 (iii) a valid identification card issued by the
24 United States Government, a state government or the
25 Canadian Government;WTF, did I miss something, have we annexed Canada? Why would we use identification from a foriegn country as proof of U.S. citizenship or legal foriegn resident status?
26 (iv) a valid United States passport; How would a non-citizen obtain a U.S. passport?
27 (v) a valid Armed Forces of the United States
28 identification card;At least I understand this since citizenship is not required for enlistment in U.S. Forces.
29 (vi) a form of identification as listed in United
30 States Attorney General's Order Number 2129-97 Interim

The stuff regarding the driver's license really bothers me since an offer of voter registration is made when a DL is issued and thinking back, I don't remember the PennDot clerks requiring my wife (Korean born) to provide proof of citizenship (she became a citizen in 1975) when she got her first PA DL in 2001.
