    Default registering a firearm

    first question do you have to register a handgun in pa? if you purchased it from a dealer in pa is it already registered? if not how do you do so?

    There is no "registration" in PA. As a matter of fact, it is prohibited by law.
    §6111.4. Registration of Firearms.

    Notwithstanding any section of this chapter to the contrary, nothing in this chapter shall be construed to allow any government or law enforcement agency or any agent thereof to create, maintain or operate any registry of firearm ownership within this Commonwealth. For the purposes of this section only, the term “firearm” shall include any weapon that is designed to or may readily be converted to expel any projectile by the action of an explosive or the frame or receiver of any such weapon. (Added by L 1995. Spec. Sess 1, Act 17(6,), eff 10/11/95.)

    Does this mean that NYC Mayor Bloomberg is breaking our laws by forcing some of our gun stores (Dunkelbergers, John's Gun and Tackle) to send him copies of firearms sales here in PA?

    Didn't those firearms dealers agree to an out-of-court settlement? If so, nobody's forcing anybody to do anything - they voluntarily agreed to it.

    Anyone that releases info on transfers of firearms is in violation of law in PA. The same passage that privatizes our LTCF also privatizes transfers.



    18 Pa.C.S. § 6111: Sale or transfer of firearms
    (i) Confidentiality.-- All information provided by the potential purchaser, transferee or applicant, including, but not limited to, the potential purchaser, transferee or applicant's name or identity, furnished by a potential purchaser or transferee under this section or any applicant for a license to carry a firearm as provided by section 6109 shall be confidential and not subject to public disclosure. In addition to any other sanction or penalty imposed by this chapter, any person, licensed dealer, State or local governmental agency or department that violates this subsection shall be liable in civil damages in the amount of $1,000 per occurrence or three times the actual damages incurred as a result of the violation, whichever is greater, as well as reasonable attorney fees.

    That`s true there was no coercion just a billionaire mayor with the full resources of NYC threatening to sue Mom and Pop stores right out of their life savings, livelihood and the ability to feed their family. Yep the agreed under their own free will.

    Even if part of a settlement agreement, the business owners are violating PA law by providing this information to someone else. I could never do business with such an establishment.

    If that was the case then the state of Pa should be able to put a stop to the whole process yet they don`t. Where are our state lawmakers that should be standing behind these local businesses.
    Unless one has stood in their shoes on the verge of losing everything(and yes just the cost of successfully defending one`s self could put a small business under) they don`t have the right to judge.
    I didn`t see any legal wizards or lawmakers standing up offering to defend the principals pro bono when this went down.
