Legality of giving spouse a handgun?
Buddy just bought a new LCP at gunshow this weekend. Wife decided immediately it was now hers. He asked me if he was allowed to give it to her or whether it had to be transferred to her, or what.
I honestly don't know myself.
Any ideas?

Yes it can be gifted from husband t wife with no paperwork being done. As long as she is not a restricted person.

(c) Duty of other persons. -- Any person who is not a licensed importer, manufacturer or dealer and who desires to sell or transfer a firearm to another unlicensed person shall do so only upon the place of business of a licensed importer, manufacturer, dealer or county sheriff's office, the latter of whom shall follow the procedure set forth in this section as if he were the seller of the firearm. The provisions of this section shall not apply to transfers between spouses or to transfers between a parent and child or to transfers between grandparent and grandchild._________________________________________

The only thing that would prevent him from simply handing it to her and it then becoming "hers" would be if he knew that she were a prohibited person (which I'm assuming is not the case).
Also, she can carry the gun even if it is still "his".Get your "Guns Save Lives" stickers today! PM for more info.
