    Exclamation PA LAW RE: .177 PELLET GUN

    Can someone point me to the actual law(s) on owning, shooting, and hunting outside with a .177 pellet gun in PA and in particular Montgomery County.

    Pellet rifles may be controlled by local ordinances since they are not "firearms" by the definition(s) used in the Uniform Firearms Act (Title 18 ch.61)

    As for hunting they are not allowed for any recognized game species.

    Title 34, Sec. 2308 "Unlawful devices and methods"

    Sec. 2308. Unlawful devices and methods.

    (a) General rule. - Except as otherwise provided in this title, it is unlawful for any person to hunt or aid, abet, assist or conspire to hunt any game or wildlife through the use of:

    (5) Any device operated by air, chemical or gas cylinder by which a projectile of any size or kind can be discharged or propelled.

    (Not sure about pest control)

    State law says no airpowered guns can be used to hunt with. So, forget that subject.

    No state laws against possession or shooting them in MontCo. However MontCo and its municipalities may have ordinances against shooting.
