    Default Ownership Rules and Regulations

    Hypethetical questions:

    1. You purchase a WW II G.I. Foot locker at a yard sale. You get it home and discover a non papered Class three weapon with in the foot locker.

    2. A WW II G.I's widow wants to give you a war bring back non papered class three "War Trophy" weapon, her husband brought back from WW II.

    What is the current fire arms policy and or procedure on taking legeal ownership in these types of situations, or is there one?

    Non papered = time in the klink!

    By non papered... I mean that they never registered the Class III with the ATF.

    If they did...you can transfer it to you.

    If not... gotts be melted down... or given to a museum I suppose (and made non functional)

    Thee is none.

    Non registered NFA weapons are contraband. Period.

    Torch it (and then torch the pieces)

    BTW, as a side note, because I am a nit-picker : there are no "class 3" weapons. "Class three" is a type of special occupational tax paid by an FFL for the priviage of selling/dealing in title-2 (NFA registered) weapons.

    Not a legal option.

    If one were to "hypothetically" accidentally end up in possession of a non NFA reg'd Title-2 firearm there are 2 options.

    1) Turn it in to ATF (IMO this is risky, ATF is not your friend)
    2) destroy the receiver.

    Another theoretical variation...What about if the firearm found or given from a non-relative was an old 1911A1, Luger or other WWII era pistol? Would a person be able to take legal possession of it?

    If it is a title-1 firearm then std fed and state laws apply.

    Torch the receiver and built it as a semi.
