    Default Private Gun Sales

    Is it legal to sell a pistol to another individual w/o going thru a dealer? What about a long gun?

    Long gun = YES
    Pistol = NO ... . some "gifting" are OK in families
    NFA = NO

    In PA:

    Handguns must go thru a FFL or Sheriff unless they are parent/child, spouse, or grandparent/grandchild related. The type of transfer means nothing, IE: sell, trade, gift. ...just the transfer of ownership.


    Long guns(rifles & shotguns) may be traded, gifted or sold like you'd sell a used video game or tv.

    Across state lines: ALL transfers have to go through a FFL unless its via bequeath or instestate succession(someone has to die for that).

    In Pa.? (I ask because your profile says Va.)

    Interstate: No.
    Handgun must go to FFL in recipients state (bequeath is exempt).
    Long guns must be transferred at an FFL in either state.

    Intra-state (Within Pa.): Depends.
    Handguns must generally be transferred at an FFL or Sheriff per 18Pa.C.S.6111. Exceptions include grandparent-parent-children as well as between spouses, FFL's, etc.
    Long guns do not require any FFL intervention between residents of Pa.

    No. There is no distinction between gifting and selling in paragraph (c) of 18Pa.C.S.6111

    Grandparent-parent-child, spouses can "transfer" (which includes both gifts and sales/trades) without FFL involvement.

    I should have been clearer - in VA (potentially selling to a friend in VA & I'm from VA).

    i just called the Baltimore ATF and told them I am in PA and wanted to buy a rifle from a private citizen in Maryland.
    I asked them if it had to be transfered by an FFL and they said no as long as I am driving there to pick it up and not having it shipped.

    This is a PA based forum.. Unless someone else speaks up here that knows VA law, then you will need to consult a VA specific forum. Federal law only regulates commercial transfers. VA could, which I doubt, regulate private transfers.
