    What does this mean? In Pa firearms are handguns. So if you are under 21 you can carry a loaded rifle or shotgun in your car?

    There was a post on Reddit from a guy who called and was told that they hadn't heard of any such ruling.

    The ruling is explicitly limited to "declared states of emergency", which the prior governor was fond of declaring over hurricanes, Covid, & opioid addiction. They all expired, and the Legislature curtailed the ability to declare future SOE's of indefinite terms.

    So it's a positive opinion, but it may have no real-world impact while it's in effect, unless the new Gov declares another SOE. Possibly when Biden declares martial law and suspends elections until the Chinese TikTok menace has passed.

    With respect to Title 18, Section 6106, the definition of "firearms" is given in Title 18 Section 6102:

    Firearm." Any pistol or revolver with a barrel length less than 15 inches, any shotgun with a barrel length less than 18 inches or any rifle with a barrel length less than 16 inches, or any pistol, revolver, rifle or shotgun with an overall length of less than 26 inches. The barrel length of a firearm shall be determined by measuring from the muzzle of the barrel to the face of the closed action, bolt or cylinder, whichever is applicable.
    "Firearms" as used in this statute specifically covers more than just handguns. It also includes NFA-registered short-barreled rifles and short-barreled shotguns as well. If you have an LTCF, you can carry an SBR or SBS loaded in a vehicle too, not just pistols or revolvers.

    Judge Stickman Vacates Portions of Injunction Against the PSP Without Opportunity For Plaintiffs To Respond

    As our viewers know, on Wednesday, Judge Stickman issued a monumental injunction against the Pennsylvania State Police (*PSP*), which, among other things, enjoined the PSP from prohibiting 18 to 20 year olds from obtaining a license to carry and permitting them to carry a concealed firearm in the absence of a license to carry firearms. Today, the PSP filed an emergency motion to alter/amend the injunction, which the Court granted within almost an hour of filing, without opportunity for Plaintiffs to respond, violative of Plaintiffs* due process rights.

    The new Order only precludes the PSP from arresting 18 to 20 year olds, who openly carry a firearm during a state of emergency; thereby, dissolving the injunction as it relates to prohibiting 18 to 20 year olds from obtaining licenses to carry firearms and permitting them to carry a concealed firearm on their person or in their vehicle in the absence of a license.

    The Plaintiffs are currently considering their options, including appeals or whether to bring a new federal court action.
