    Default C&R QUESTION

    I've always wondered about this question
    If I have to enter a long gun purchase into my C&R bound book
    and later want to get rid of it and another PA resident wants it,

    can I just enter his info as a private transfer or does it have to go through an FFL ?
    I know it can go to another C&R holder.

    Semantics....I think he meant that you wouldn't need to put an FFL down, simply the private transferees name and info.

    PA law does not require an FFL transfer of a long gun between its residents who are not prohibited. If it had not been recorded in Puccini's bound book, he could have just sold it to a non-prohibited resident. He is not required to do so, but it is prudent to ask to see an LTCF or a recent SP4-113 Firearm record of sale form as "proof of eligibility" because non-FFLs can't do background checks.

    Because Puccini recorded the long gun in his book as required by his C&R license, it has to be disposed of in the book to a buyer. So he just needs to do that, and note "non-licensee" next to the buyer info.

    A C&R isn't a license to sell. It is a collectors license. You would enter the buyer's info in the bound book. Disposal of firearms acquired with use of the C&R follow what state/federal laws require on private transfers. PA only requires a background check on PA defined "Firearms", not rifles or shotguns.

    And if disposal out of the C&R log book to a resident of another state, the firearm would have to go through a FFL if the recipient isn't a C&R holder. ...handguns thru a FFL in the recipient's state, long guns via a FFL in any state.

    Now, a FFL transfer for a long gun affords a person legal protections - which is a benefit.
