Default How long do I have to get a 302 expunged?

I read somewhere that you have 6 years from the 302 commitment to get it expunged. Is this true? Also how do I confirm that there is a 302 in effect? There was no 302 hearing.

If you went to a psychiatric hospital and did not sign admission papers, it was a 302 commitment (up to 5 days). There is only a hearing if the hospital recommends further inpatient or outpatient care via commitment.

I don't remember if I signed admission papers or not. This was 2014. Is there any way to be sure?

Hire a lawyer to get the hospital records if any records still exist. You may also want to read this article - https://blog.princelaw.com/2019/08/0...ms-disability/

This. Read the older post you posted a similar question to for more details on what the process is. But in the end you need to get a lawyer experienced with gun rights to get it done correctly. Our resident expert Gunlawyer001 (Phil Kline) or Princelaw would be great places to start.

    Best of luck.

Gunlawyer is the shit. If he can*t clear it up, it can*t be cleared up.
You should consult with him at a minimum- you need to determine your status. Do NOT just roll the dice and try to buy a firearm. If you*re prohibited, you*re opening the door to potential criminal charges.

Thanks for telling me that. I DID consider just trying to buy a gun to see if I get it or not.
