    1) The citizen following the book after discharging his weapon?

    OR

    2) The responding PPD officer?


    Police say the 62-year-old man was walking his dog on a leash near 20th and Chew Streets when two loose dogs approached and began to attack his dog.

    The man attempted to break the dogs up and pull his dog away before pulling out a 9mm handgun he was licensed to carry. He fired twice, killing the larger of the two dogs.

    The second dog ran from the scene down a nearby alleyway.

    Police say the man then walked his dog home and put him inside. Then, he walked to 21st and Conlyn Streets where he saw a uniformed Philadelphia police officer.

    He proceeded to inform the officer that he had just fired his weapon at a dog around the corner and that his gun was holstered on his side.

    At that time, police say the officer informed the man that he would have to secure his firearm. The man placed his hands over his head so the officer could access the gun.

    Philadelphia police say that while the officer was attempting to remove the man’s gun, he accidentally fired it. The man was shot in the right leg and the officer immediately rushed him to a nearby hospital where he was placed in stable condition.

    I wonder if the dead dog has been removed or if it is still lying out there baking in the sun.

    ...and I've been told that PPD S.O.P. is to call and have SWAT clear all weapons.

    Hmmm.

    Probably best to
    1) call 911 (instead of looking for some guy on the street) to self-report a legitimate discharge / warn them about another angry dog out there
    and
    2) clear your own weapon long before PPD shows up, lay it down somewhere safe and not be too close when they show up.

    It's probably impossible to prevent a determined LEO from taking your weapon, but this is a very good reason to clearly state you are "complying", NOT "consenting" and submitting under duress. I'd bet voluntary submission is a factor in any civil action, and might reduce damages awarded.

    Years ago I was rear ended and suffered injuries .When police arrived I informed them of my Glock 23 on my hip and unable to remove it myself and clear the action ! Officer asked my permission to remove said weapon .All done safely and My wife arrived with her car ,Officer asked to put the Glock in my wife's trunk and she followed me behind ambulance ! See Some Officers go by the book ,safely and expeditiously with concern for my safety and well being .Sadly I forgot to tell Officer of my S&W model 36 on my ankle which was discovered at hospital by X ray Tech .Again no big issue and was handled safely .
