can a felon hunt with a black powder rifle?
I was convicted on a drug charge 7 years ago in Pa and received an unclassified felony convition. I have asked several gun shops and police officers and no one has been able to give me a solid answer whether it would be legal or not to hunt with a black power gun . There is no paper work or any backround check required to purchase a black powder gun. For this reason many gun shop owners have told me "if you can buy it you can use it". I would love to get a solid answer. There is no deer that is worth going to jail for. Thanks

Re: can a felon hunt with a black powder rifle?
wow thats a good question. I am thinking that no you cannot, however im having trouble supporting that with fact.
Under certain sections a black powder rifle does not meet the definition of firearm. Other sections it does.
I looked, but I'm sorry, i cannot provide you with a clear answer.

Gun shop employees and police officers are notorious for not knowing the firearms laws.
If we read the actual law it seems pretty clear to me.
Your felony conviction prohibits you from possessing firearms per 18Pa.C.S.§6105
Paragraph (i) defines "Firearm" for that section as follows.
(i) Firearm.--As used in this section only, the term
"firearm" shall include any weapons which are designed to or may
readily be converted to expel any projectile by the action of an
explosive or the frame or receiver of any such weapon.
There's always archery, which IMO is more fun anyway._________________________________________

If you have/had a PO I would contact them, because they will know the things that will get you violated, otherwise call pa game commission they are the ones who would be enforcing the law you would get in trouble for violating.

I am just saying there are official people in the business of dealing with these issues. People whose job it is to know and apply these laws that this man could talk to, and get better information than asking people on a gun forum.

You're going to be VERY hard-pressed to find a better source of accurate, reliable information than this forum. Parole/probation officers (and even police officers) are NOT a source of legal advice. If you need more "official" information than what's found here, get it from an attorney.

Yes, and those people would be attorneys. Not the game commission. Trust me, asking the game commission is like asking an LEO. You never know who you will get or what kind of accuracy their answer will hold.
That said. The law is above and it's pretty clear. If he can not legally possess, he can not hunt with it. Been hashed out before both here and elsewhere._________________________________________

You are right the attorney is the best way to go, but an attorney cost money. Which is most likely the reason he went to a forum in the first place.
