    I dunno, reading the description of what went down, it seems like it is the correct result. They had NO direct evidence that she had a BAC over the limit. Everyone in contact with her after the accident said she neither acted drunk nor smelled like booze.

    She DID still lose her license for a year for refusing the official BAC test, though. I think that's fair.

    Seems that either the DA or the judge are delusional.I wonder why Kane refused to take the BAC test?

    As I reconsider the facts, I'd have to agree. Her statement that she was the DD is a little contrary to some of those facts though, since apparently there was video of her consuming alcohol.

    Because she knew she would fail? Anyone in that situation would do the same.

    I cannot figure out why she took the sobriety tests. Her being an attorney she should have known those sobriety test are designed for the driver to fail. They are mostly completed on the side of the roadway with oncoming traffic, uneven surfaces, and flashing lights from the police vehicle all that are not favorable to the test taker. Even if passed that is not a guarantee that the driver is off the hook.

    I suspect a field sobriety test has some level of subjectivity and an attorney could certainly address that. A BAC test result would be rather difficult to argue against.
