    Without further information how the theft occurred the primary charge would be Theft of a firearm in violation of one of the varied theft offense listed in 18 Pa CSA Ch 39 graded as 2nd class felony (10 years/ $25000)

    Other charges could attach depending on how the theft actually occurred. Robbery, burglary, criminal trespass, etc. Was it a B&E, was in an occupied home at the time, was there a threat of violence, ... ???

    I guess one could say 'fortunately' the value of the firearm doesn't matter when the provided statute is violated. That eliminates need for argument over its value.

    Within the muzzleloader community if someone was to stumble upon a custom rifle from TVM (Matt & Toni Avance) I would be surprised if they didnt contact Matt for provenance. Hopefully thats what happens and Toni will contact you.

    I don't believe any 'theft of firearm' charges would apply because neither ATF nor the state of PA consider a flintlock a firearm. I believe theft charges here will solely be based upon the assessed value, i.e., as if say a valuable piece of jewelry or piece of art was stolen. One thing you need to do is to get a letter or receipt from the maker to document the current value of the piece.

    Go back and read the Ch 39 link I provided. Specifically §3901 Definitions:
    "Firearm." Any weapon that is designed to or may readily be converted to expel any projectile by the action of an explosive or the frame or receiver of any such weapon.
    and
    § 3903. Grading of theft offenses.

    (a) Felony of the second degree
    (2) The property stolen is a firearm.
    Value is irrelevant for firearms as defined above.

    The flintlock has been recovered. Thank you all for your advice. After putting the pressure on about reporting it to the police, it miraculously appeared in a closet that I never placed it in. I don't want to get into details and make accusations. I do believe that someone was involved in taking it and placing it there out of fear. I really thought it was gone for good and I'm happy to have it back.
    PS: I had checked that closet several times when I was going through the house and looking for it. It wasn't there.
