PFA- getting guns back
Long story short- im going through a divorce. Wife wanted the house. I said no. She made up a bunch of lies to file a PFA against me. Attorney advised to agree out of court to a 6-month PFA(claimed with the womens rights crap going on and owning scary black guns it wasnt worth risking 3 years of a PFA if she agreed to 6 months)
So it expired on April 16th. I have been calling the Cumberland County Sheriff only to get no response back. The lady that answers tells me that they need to do some paperwork before I get them back. So I tell her to transfer me to the sheriff and thats where it stops. Can anyone help me with what to do? I know I can contact my attorney but I was trying to save some money if someone here could help me out. Thanks. Ryan

Pm Gunlawyer he is a moderator. You may need to file some paperwork and its best to do that with guidance, then you wont loose your rights.

That's a really unfortunate situation, I hope everything works out for you in the end. Gunlawer or SigForLife should be able to offer some good legal advice.
It should be noted that if it's this easy to get jammed up just going through a divorce, imagine what could happen if PA passes red flag laws.

This is standard operating procedure these days for divorces.
I'd get an attorney and that should expedite the process.

I have an attorney. I was just trying to save the $400/hr to get my guns back. If I need to its fine.
Id love to share more but the process is still going on so I cant.

Keep in mind that PA law allows for the recoup of money spent on Attorneys to get your guns back from the police (or Sheriff) if you need to go to court to push the issue. Unfortunately, it's after midnight and I'm not going to research and cite the PA CS18 61xx statute, but it's there if you care to do some reading!

While it shouldn't be necessary, it seems that "get a court order" is the default response, rather than noting the date on the paperwork, and the calendar, and returning them because there is no longer a legally valid reason to NOT do so.
When it became apparent (years ago) that I was headed for divorce, I immediately transferred all my firearms to my father, and documented the transactions with notarized documents. I was never subject to a PFA, but it was a simple and inexpensive insurance policy that I'd recommend to anyone.Get your "Guns Save Lives" stickers today! PM for more info.
