So if when you pick up the lower and fill out the 4473 form and they put down other .How do they know if you are building a pistol or rifle .? And if your first build is a rifle than legally you can't put a 7.5 inch upper on?

Why do you think they would or should know what you are building?
At that point, it's an "other". End of their involvement. What it gets built into is not relevant to them or the paperwork.
The answer to your second question is: "Correct" - if you start out making a rifle, you can not switch it to a pistol later on.
You may be able to make it an SBR though by filling out the proper forms, but a pistol is a "no".I called to check my ZIP CODE!....DY-NO-MITE!!!

They don't nor do they have any need to know. What you build from your "Other" is up to you and only you need to know - DO NOT allow them to try to tell you that they need to know, they do not for any reason.
Legally you cannot put a 7.5" barrel on it as you would be constructing a SBR UNLESS you fill out a BATFE Form 1 and pay for the tax stamp to make it into a SBR. Then, when made into a SBR, you can swap the barrels to have a full size rifle or a short barrel rifle.
If you first remove the rifle buttstock and then the barrel and put on a pistol brace and a short barrel to make a pistol, technically you are breaking the law (but who is going to know?). But you can do a Form 1 to legally make a rifle into a pistol.Last edited by Xringshooter; April 15th, 2020 at 11:30 AM.

Not true, you CAN build a pistol from a rifle, you just have to fill out a Form 1 and pay the $200 tax stamp. Section 4.b. (Type of Firearm to be made) is defined under Definition 1.c.
Now why you would want to do that is beyond me, lower receivers are cheap, buy another and build the pistol from the ground up.Last edited by Xringshooter; April 15th, 2020 at 11:28 AM.
