    Default Firearm law question

    A friend of mine has a glock 19 built on a 80% lower and he want to sell it to me. At this time I am not kin on going to the dealers and wait for hours to get in and then probably been told that they don't do private transfers at this time. Since the gun does not have a serial number and it has not been register through a dealer can a private transaction be done just like with long guns?
    I don't want to get in trouble and I don't want him to get in trouble but he suggested that most likely it would be ok and he wont have a problem with it. We are also neighbors so there will not be travelling involved and that is really what it appeals to me at this time.
    What you guys think? I have no idea about this 80% guns. Also any problems that I should be looking for? I know he has been firing it at the range and he told me everything works as it should.

    No.

    You can't even have it transferred as far as I'm aware without a serial number. The 80% kits are meant for personal use only.

    Serial numbers aren't required. You can sell/give away a firearm that you personally manufactured. Only Federally Licensed Manufacturers, and any manufacturer of a NFA device, is required to put a serial number on the firearm/device.

    If that's the case then can't we sell a finished lower?

    You can sell a finished lower. You cannot be in the act of manufacturing federally defined "firearms" for commercial purposes without a FFL, which then requires a serial number.

    You can make your own guns/receivers, you can sell your own guns/receivers that you made for personal use. You cannot be in the business of doing such without a FFL, which in turn requires you to place the serial number.

    PA then regulates transfers of PA defined "firearms". ...so that factors in after.

    Remember, you have to abide by the laws in this order: Federal, State, Municipal in PA (in some states it is: Federal, State, County, Municipal)

    Question would be, what does an FFL do with that home-brewed firearm, if being transferred, as required by state law pertaining to handguns

    The gun in it's present condition is a "firearm", PA requires "firearm" transfers to have a background check performed unless the transfer is between spouses, parent/child, grandparent/grandchild, or it is received via bequest(via a will) or intestate succession(family inheritance).

    Unless you are married to the person, or that they are your parent, grandparent, child, or grandchild, or that they left it in a will, or that you are otherwise related to them and they died without a will - it must be transferred through a FFL. <---- this sentence is your answer.

    I though that it would not be allowed but what he said make sense. No serial number no tracking. Now that I know it is illegal I will wait for the right time to purchase the gun.( When the shops are fully opened again). However how would they track who purchased the lower and who made it into a functional gun?

    I don't think one can sell it...ever. I'd like to know what happens when its owner dies. And as to the bolded line above...because you just told everybody.
