    I think I am going to stay away from it then. I am also going to tell him to check with the ATF on the process. He may be better off just keeping it. Its a great shooter according to him so why sell it.

    Can’t he just sell you the 80% lower? Put some JB weld in the holes he drilled and whatever and sell you an 80% lower?


    Next week, maybe he could sell you some additional parts to go with it.

    Disclaimer: I don’t know shit about 80% lowers and what is involved in this kind of stuff...I’m am totally guessing.

    Although it may be possible to do what you are suggesting I don’t think its worth the risk. The only reason I was considering is because he offered it in exchange for something else no gun related. I prefer to purchase a regular gun and not having to worry about any legal issues. Thanks for your suggestion though.

    He can serialize it then sell it as long as the initial intent was not to sell it. The easier way would be sell you the slide assy, and the lower parts kit then go get your self a polymer 80 lower and finish it yourself. You cannot have him jb weld the holes and he would have a hell of a time doing the same for the tabs that had to be removed.

    This. It just has to be serialized per the GCA of 68.

    In terms of enforcement, you're absolutely correct that there's no way of tracking. There are tons of situations like this with firearms law.

    -intent to sell a firearm as soon as it's purchased - illegal straw purchase. But no intent until 3 seconds after it's transferred and you say actually forget it, I really shouldn't have spent the money... Hey Jim will you buy this for what I paid? Completely legal. How do you enforce intent?

    -finish a form 1 suppressor before your tax stamps arrives - illegal... But as soon as it arrives, who really knows the timeline?

    -build a virgin AR receiver into a rifle. It has to stay a rifle at that point. But you say screw it and build it into a pistol.... Who would really know?

    I suppose the point is that we are law abiding citizens and should follow the laws regardless of how dumb, unconstitutional and unenforceable they are.... Now don't you feel good about being a good person?

    No, the only way to make it a non gun again is to cut the lower up. He could sell you the parts kit and you finish your own 80% lower, or seralize and sell

    The firearm can be transferred without having to mark anything on it. ATF "suggests" you mark it with a serial number, but it is not required, and wouldn't help anyway in the case of a trace.
