    Default Monroe LTCF Denial over references

    A quick question because I haven't seen any results. Does anyone have any knowledge of successfully appealing a lctf denial due to references not responding? Or a ballpark of what to expect for the costs? I know the lawyer wants a $4500 retainer.

    Also, if you would not appeal the decision besides having to wait a year to re-apply is there any other effects of the denial?

    It is so stupid. The laws need to be changed. Why should anyone or any clerical error besides your own prevent you from exercising a right? And cost $$$$ in lawer fees to do so!

    Who is the lawyer? If this is area of practice, and he has a good reputation, I'll kick in $30 for your appeal.

    You only have 30 days from the date of the denial to appeal. And I'd just appeal it myself, the initial form is boiler-plate appeal.

    this was the final issue i had with the county pre-class action lawsuit.
    if i recall i just gave them another reference and it was done. i figured the reference just never got their postcard. USPS isn't exactly great. prob why some counties (supposedly) skip contacting or just call the refs.
    all republican sheriff candicates and one democrat promised to repair their broken process, the new guy was just sworn in, too soon to see if he keeps his word, hopefully we at least remain in or continue getting in line with THE LAW AS WRITTEN and court ordered.
    There is no way to make it out alive...

    One reference says they mailed it back. The other never received it. I gave the sheriff an alternate address to try but my reference still received nothing. I called a well known reputable lawyer. I just am trying to justify dropping that much money. And this was a renewal but now my old licence expired.

    Have you actually received a "denial" letter, or are they just refusing to process?

    Either way, 4k doesn't seem out of line. That's about what my costs were to reverse a revocation, and that was over 10 years ago now.

    Should be an easy winner. While the sheriff is to conduct the investigation, he has a max time. The fact that he can't do everything he'd like to do isn't YOUR problem or a lawful reason for denial.

    My wife was denied because they never received one of the references. They let her submit another app and she only had to put down one reference on that one. She was officially denied by letter in the mail and it wasn't an issue.

    Yes, I just received the denial letter with the reason being "Applicant did not provide this office with required information or documents; document in question is both of your references". It just frustrates me to have to spend that kind of money over a denial that relies on USPS and people other than myself!

    That's why I used people I see regularly. When they got the paperwork they filled it out and gave it to me. I mailed them out myself at the post office, but the staff at the sheriff's office told me I could have just dropped it off myself.
