    HARRISBURG, Pa. (AP) — Pennsylvania’s top prosecutor said Monday he has told state police to treat unassembled “ghost guns” as firearms under state law, meaning felons may not legally possess them.

    Democratic Attorney General Josh Shapiro issued a legal opinion to the Pennsylvania State Police that the gun frames, also known as “80% receivers,” qualify as firearms.

    The guns can be quickly assembled but lack serial numbers, so they cannot be traced.

    Shapiro’s opinion, in the form of a letter issued Monday to the state police commissioner, Col. Robert Evanchick, says the 80% receivers are firearms if they are designed to expel a projectile by the action of an explosive, or if they can be readily converted to do so.

    “No single factor is dispositive,” Shapiro told Evanchick. “The PSP must weigh all the applicable factors together to determine whether a receiver ‘may be readily converted’ to expel any projectile by the action of an explosive.”

    Shapiro said the guns are increasingly being found in the hands of people who are barred from possessing firearms. He said the attorney general’s office found felons purchasing the kits at recent gun shows in the Philadelphia suburbs, York and Harrisburg.

    The state police plans to issue guidance about what that means for gun shops and other sellers.

    "Today, in a press release entitled ” AG Shapiro, Gov. Wolf: 80% Receivers Are Firearms” Pennsylvania Attorney General issued an opinion letter regarding, putatively whether 80% lowers (which have no legal definition or meaning) are firearms for purposes of some, but not all, provisions of the Pennsylvania Uniform Firearms Act (“UFA”).

    While acknowledging that “there is no controlling caselaw providing a definition or standard for applying the phrase ‘may readily be converted'” nor a definition for “designed,” in direct violation of Article 2, Section 1 (non-delegation provision), the preemption provided for by Article 1, Sections 21 and 25, and the rule of lenity, Attorney General Shapiro concludes that “a receiver is a ‘firearm’ if it can be converted to expel a projectile by [sic] individual with reasonable skill (expertise), basic tools (equipment) available to and understood by such an individual, and commonly available parts (availability) in a reasonable amount of time (time).” Thus, apparently under AG Shapiro’s opinion, a block of metal or plastic can now constitute a firearm.     How did they find these people if there were no background checks being performed?

    Ohh well he said it so it must be true.

    Wont there need to be an actual law passed in order to keep these from being mail ordered, shipped into the state, and require a transfer? No fucking doubt this was planned with Bloomturd since he just petitioned the ATF over this very issue.

    What will this mean for the share deals and steals thread?

    I was wondering the same thing because the article states "Felons can not be in possession of them"---Felon? In possession of what? Part of a gun that can not function? Here's the ATF definition:

    “80% receiver,” “80% finished,” “80% complete,” “unfinished receiver” are all terms referring to an item that some may believe has not yet reached a stage of manufacture that meets the definition of firearm frame or receiver found in the Gun Control Act of 1968 (GCA). These are not statutory terms or terms ATF employs or endorses."

    How can a law be enforceable upon a "legal opinion"?
