    Great work, great result. Now let's get HB 1066 passed so next time there will be real teeth in the preemption law. I suspect Peduto with Bloomberg money will appeal the decision.

    Now we should have another OC rally in PBurg demanding his impeachment!

    It's a real shame that there's no actual punishment for those that violated the law by passing these illegal ordinances to begin with. The only people that are punished are again the taxpayers because they had to pay the legal fees incurred by the city defending their illegal activity.

    And folks like us that had to contribute to help defray the cost of the challenge to Peduto's criminal activity. The violations of law by the politicians are so outrageous and it is absurd that citizens have to risk their rights and their finances to see justice done. As you point out, justice is not really done here. The Allegheny County DA could have pressed criminal charges but did not. Basically the law is toothless and only alert patriots willing to take risks can enforce it. If the stay on enforcement had not been agreed to, that same DA would have been falling all over himself to prosecute innocent law-abiding citizens.

    Gun restrictions passed by the city of Pittsburgh earlier this year were struck down by an Allegheny County judge on Tuesday.

    Judge Joseph James agreed with attorneys for gun rights advocates that the Pennsylvania Uniform Firearms Act trumps the city's ability to pass such legislation at a local level.

    "Stated simply, under the doctrine of field preemption, the UFA preempts any local regulation pertaining to the regulation of firearms," James wrote. "The Uniform Firearms Act is a comprehensive statute that evidences an intent by the Legislature to preempt the entire field of firearms and ammunition across the state of Pennsylvania."

    The Pittsburgh legislation would have prohibited the use of assault weapons and large-capacity magazines within city limits. It would have also provided a way to prohibit people deemed to pose an "imminent risk" from having a gun.

    The gun bills were signed by Mayor Bill Peduto in April. The laws were quickly challenged in court and were never enforced, with James issuing a stay until he made his ruling.

    Tim McNulty, a spokesman for Peduto, said the city would appeal the judge's decision.

    "The city and its outside legal counsel have always expected this would be a long legal fight, and will continue to fight for the right to take common sense steps to prevent future gun violence," McNulty said. "We will appeal."

    If it gets to the PA Supreme Court they'll probably pass it.

    We have to knock this down in the Appeals stage.


    Pudendo is relying upon Bloomberg financed "legal help". We have to counter it.

    We can dream but in reality these buzzards are using the Courts to legislate. Kind of like how we ended the Chicago and San Fransisco gun bans.

    I wish I could make an example out of the Pudendo administration but that's not going to happen. Gotta take the good with the bad.
