    Default UPDATE! Ephrata Borough Carry question. WIN

    I don't know if any knows about the old rail road tracks the borough turned into a trail/walking path that goes for a good distance and is actually really nice if your bored and you wanna go for a walk. Asking a friend who is a police officer, he said he thought you cannot carry even with a LTCF on that path.

    I looked into Ephrata code and such.

    Chapter 221: PARKS AND RECREATION
    § 221-1. Definitions and word usage.
    A. As used in this chapter, the following terms shall have the meanings indicated:


    RECREATION AREAS — Includes any park, playground or other place or facility maintained and operated by the Borough of Ephrata as a place for recreation, relaxation and/or the enjoyment of nature and the out-of-doors.
    B. In this chapter, the singular shall include the plural, the plural shall include the singular, and the masculine shall include the feminine and the neuter.

    § 221-4. Prohibited acts.

    E. To hunt or to possess within any recreation area any firearms, air gun or bow and arrow unless such area has been set aside for such purpose and then only according to special regulations for such particular area.

    Anyone have any information about this? They did put up a sign with some rules I am going to go check out later on and find out what it says as well.

    The law is invalid, as it conflicts with state law. Disregard it.

    That's what I thought. I am curious now to send a letter and find out if I get a response.

    If you want to send a letter to anyone, send it to your DA or ADA. They're the ones responsible for actually indicting you, and they will likely know that the law is invalid. If not, however, anyone arrested and charged for it will quickly have it thrown out in court.

    Do places that ban firearms, think they can get away with it? I always thought they can make their own laws/rules about it. Since joining here I see that it is very different. Thank you to the states law about it.

    If the borough owns the trail, can they do this? or doesn't it matter?

    If the borough (or county/township) own it, NO they can't. However, if it's privately owned, the private owner can. Step 1, find out for certain who owns it. Step 2, if it's the county/township/city/whatever contact them about the violation, and supply them with the section of the UFA that they're violating. I'm sure someone here could help you compose a letter, if necessary.

    § 6120. Limitation on the regulation of firearms and ammunition.

    (a) General rule.--No county, municipality or township may in any manner regulate the lawful ownership, possession, transfer or transportation of firearms, ammunition or ammunition components when carried or transported for purposes not prohibited by the laws of this Commonwealth.

    As mentioned, the ordinance is illegal and unenforceable and shuld be removed.

    How/where do I find out who owns it? Just call their office and ask who owns the parks, and this Linear Park Trail?

    It says RECREATION AREAS — Includes any park, playground or other place or facility maintained and operated by the Borough of Ephrata as a place for recreation, relaxation and/or the enjoyment of nature and the out-of-doors.

    I know both parks are maintained by the borough already that's all who is ever out there keeping it in shape and so on.
