Red Flag Gun Control Standoff With Afghan War Veteran in New York

A Military Vet, known online for his pro-gun views and his posts on Instagram, was in a seven hour standoff with Putnam County, New York police after being red-flagged for having a 30 round mag (above the legal limit in NY). His house was surrounded by police, including an APC and SWAT officers.
According to the 28-year-old Afghanistan veteran, Alex Booth, police showed up at his workplace on Saturday and tried to arrest him over social media posts that were reported to them by an old army buddy. Alex then slipped out the back door, and quickly made his way home to check on his family which he claimed were threatened by the police.
According to text messages sent out by Alex during the so-called standoff, the local Sheriffs department threatened his wife, telling her that child protective services would remove her newborn child from the home. When he got home he found that the police had already confiscated his legally owned firearms.
This is when the seven hour standoff begun. Police, ironically fully armed with their own 30-round magazines, claim they heard gun shots, and that is why they surrounded his property. But according to official reports from the Putnam County Sheriff’s Department, reports that they have now deleted from their Facebook page (I will include them the end of this article), they found no guns or “feeding devices” at the home upon arresting Alex Booth.
But how could that be? The official story was they heard gunshots and then surrounded the house. Is this why the post has now been deleted?
Alex Booth, AKA WhiskeyWarrior556 on Instagram, surrendered to police after being threatened again that they would take his infant daughter from his wife’s custody.
Keep in mind, this is a man who served his country who was surrounded by swat teams for simply processing empty 30-round magazines.
This is exactly what everyone in the gun community has been warning about; these red-flag gun control laws seemed to be designed to set up the next Waco situation, and seem to be designed to further smear gun owners. If a member of the military, a man who has served his country to fight for your freedoms can be targeted for having what amounts to a standard capacity magazines what do you think they will do to you?

A New Jersey man has lost access to his firearms after his own doctor reported him to authorities following a dispute.
Attorney James Maggs argued to state Superior Court Judge Paul X. Escandon during a hearing last week that he felt threatened by a phone call from Alfred Conti, whose guns were stripped due to red flag laws.
“It started out the first few seconds a normal call then quickly he became agitated,” Maggs said. “His overall demeanor I felt became threatening and I became alarmed.”
Maggs represents Dr. Matthew Kaufman and The Plastic Surgery Center of Shrewsbury, NJ. Kaufman had Conti’s firearms taken under the state’s red flag laws following a dispute between the two men. Now, Maggs and Kaufman want Conti’s guns to be seized indefinitely.
The dispute stemmed from neck surgery that was performed on Conti by Kaufman, which Conti deemed to be substandard. After the surgery failed to alleviate chronic pain in his neck, Conti complained, posted negative reviews about Kaufman on the internet, and began to start a social media campaign against Kaufman and his clinic.
Kaufman used the red flag laws in an attempt to strike back at Conti, who Kaufman has also sued for defamation. His scheme has worked like a dream against Conti, as red flag laws can be easily weaponized in civil disputes.
Law enforcement officials maintain that Conti was friendly while they were taking away his guns, and maintained his cool despite the fact that his rights were being egregiously tread upon.
“He was very cooperative in assisting us and his conversation with us,” said Dan Campanella, a Rumson police officer, during the court hearing about Conti’s demeanor.
“As far as (discussing) what had occurred, he maintained he never threatened anybody and has rightful grievances with both parties,” he added.
Currently, there is a class action lawsuit in New Jersey challenging the constitutionality of red flag laws:
A class action lawsuit was filed in a New Jersey court last month to challenge the constitutionality of red flag laws that take away firearms from an individual deemed a threat without due process following an arbitrary judicial decree.
Albert J. Rescinio is a New Jersey attorney representing David Greco, a man whose firearm was seized under the Extreme Risk Protection Order Act of 2018 after the law went into effect in September. He is arguing that red flag laws abrogate the constitutional rights of citizens who have not committed any crime.
“Why can’t you give people the opportunity to know what is going on? To give them the opportunity to be heard?” Rescinio said. “You are being deprived of your constitutional rights without a hearing, without being given the opportunity to know what is going on.”
Rescinio is petitioning the court of law to issue a preliminary injunction that would prevent the implementation of Extreme Risk Protection Orders across the state. The lawsuit has been filed against New Jersey’s Office of Homeland Security and Preparedness, Attorney General Gurbir Grewal, and several local law enforcement agencies.
Scott Bach, who works as executive director of the Association of New Jersey Rifle & Pistol Clubs, is working on a legal challenge against red flag laws too.
“The system is rigged against the honest gun owner,” he said.
The New Jersey red flag law allows a law enforcement officer, relative, or household member to petition the state Supreme Court to take away an individual’s firearms, despite the fact that they have committed no crime. The judge simply has to determine there is “good cause” to remove the guns, and they are seized by police indefinitely.--ET

(CBS4) – For the first time, a judge has denied a request to take away a man’s guns under Colorado’s new red flag law. A Limon woman claimed a man who she had a relationship with threatened her with a gun and filed the request.

Since the law took effect, the red flag law has had many gun owners seeing red. At least four requests have been filed since the first of 2020; CBS4 is aware of them being filed in Denver, in Larimer County and this one — in Lincoln County.
Many gun owners, like Jak Gruenberg, despise it.
“Red flag laws just allow for harassment of legal gun owners,” he said.

The law allows guns to be taken away from those who present a danger to themselves or others. The decision is up to a judge.
CBS4 obtained the request for a temporary extreme risk protection order filed in Limon. A woman wrote she was getting “verbal and physical threats” with a handgun from the man identified in the order.

She said he had a problem with alcohol and marijuana. The judge denied the request to take his guns.
“I think it’s a good thing. I think any other new law you’re going to have a lot of case law to determine exactly where the lines are,” said Gruenberg, a gun owner not associated with the case.
Lincoln County is one of the many counties that has indicated it would not honor the red flag law.
But the denial led state Rep. Alec Garnett, a co-sponsor of the bill, to say this shows it is being applied properly.
Gun owners at Bristlecone Shooting, a range in Lakewood, told CBS4 they are split on that.

“I don’t think it’s going to be applied fairly. Anybody can say pretty much what they want about anybody else,” John Shearer told CBS4’s Rick Sallinger.
Rory Coyne, who bought his first gun over the weekend, had a different view.
“Well if a person is not right in the head they shouldn’t have a gun — if they re sick in the head,” he said.
The judge’s order explaining the denial of the woman’s red flag request was not made public at the time of CBS4’s request.

Nearly 200 people in New Jersey have had their guns seized under a “red flag” law that went effect last year, according to data obtained by NJ Advance Media.
The Extreme Risk Protective Order Act, which went into effect Sept. 1, allows a law enforcement officer, family or household member to submit a petition to state Superior Court showing why a judge should issue an order to keep guns away from someone who potentially poses a danger of causing bodily injury to themselves or to others.
If the judge determines there is “good cause” to remove the guns, the judge will initially issue a temporary extreme risk protection order, and a search warrant will be executed to recover the guns, ammunition and firearms identification card from the person.
As of Jan. 22, 186 temporary extreme risk protective orders had been granted, according to the New Jersey Administrative Office of the Courts, meaning more than one person a day has had their guns taken away —

On the restraint form did I see where she checked the box that she "has a child in common with the respondent".(look at 10:24 on the video).... Second box down on the form. More to the story???.......
