This is making its way around the interwebs, supposedly it's a leaked memo of the new background check process proposed by Toomey and Manchin.
If this is true which I am not saying it is then I was correct with private sales being gone.

That seems overly complicated. Let's not forget the private party sales was the result of "compromise." And now they want to take that away too. Surely there won't be further gun restrictions in a few years.
Not to mention, the federal government has no business regulating INTRAstate commerce. That's totally a state issue.

I saw the same and was just looking to see if anyone posted it.
A couple of things have me wondering what the law will be.
First is the definition of commercial sales. We all know there are people out there that are unlicensed gun dealers. I saw one on GB who had hundreds of sales and stated he was not an FFL and if the receiving FFL required...yada, yada, yada. The point being, he was in the gun sales business. He could get jammed up for no having an FFL but I wonder if it applies to this type of individual only. Commercial sales implies business so somebody selling a gun they no longer want wouldn't be a "commercial" sale. That would mean an advertised non-commercial sale would fall outside of the regulation. So, as long as you don't have a side business buying and selling guns illegally without an FFL, then you would be exempt.
What is the civil penalty?
