    Default Justified Self-Defense Shooting?

    Basically, a would be armed robber pulls up to a roadside fireworks stand, draws a firearm, demands cash. While other employees are getting the cash, an employee gets the robber's gun and shoots him with it. Once the employee has the robber's gun, how does he establish that he was in fear of his life or serious bodily harm?

    He does not ! Now is the robber physically attacking with any device to threaten bodily harm ? I for one would not want it to go to a Grand Jury on the latter part !

    The robber could have been moving towards or trying to get the gun back from the employee?

    All the articles I read on this are short on information. But there are a lot of scenarios where it would be justified. One would be the employee has the gun, the criminal tries to get the gun back by grabbing for it. At that point you have to consider the harm that would occur if the criminal gets the gun back.

    I would imagine that the state this takes place in also matters. It took place in Texas where the limits of self defense might be interpreted differently than in some other states.

    Doesn't Texas allow you to shoot to protect property?

    I think you're only allowed to after sunset.
