Man shot by Riverton homeowner after trespassing on property sues for damages
(KUTV) —
A Riverton man who shot a person trespassing on his property is now being sued by the person he shot, according to a court filing obtained by 2News.
Derek Palmer was shot by Darris Ellis in June 2017. An intoxicated Palmer reportedly confronted Ellis and his family in their driveway. After a short altercation, Ellis shot Palmer twice, police said.
Palmer's lawyers argue Ellis should pay damages, and that Palmer, who survived the shooting, was not a direct threat to Ellis or his family at the time he was shot.
He was charged with several criminal offenses and sentenced to 18 months probation in March.

CORRECTION: Police originally stated Palmer pulled a knife on the teenagers before entering the garage. They've issued a correction to say Palmer did not pull a knife until he and the father began to fight. This story has been edited to reflect that change.
(KUTV) A 36-year-old man is recovering in a local hospital after he was shot by a Riverton homeowner.
Derrick Palmer was reportedly intoxicated when he was visiting a friend's home near Stafford View Drive and Winford Dive in Riverton Monday night. Around 10:57 p.m., Palmer went outside, took his pants off and followed two teenagers into a garage across the street, according to Lieutenant Brian Lohrke of the Unified Police Department.
When Palmer tried to gain entry into the home through the garage, the teenagers' father confronted him with a gun. The teenagers were inside with their mother at this point.
The father, who police do not name, ended up shooting Palmer multiple times — once in the chest and once in the jaw.
When police arrived, the father dropped his weapon and was detained. Palmer, however, went for the gun. Police used a Taser to stop him.
Palmer was transported to a local hospital in critical condition, but has since been upgraded to serious and stable condition.
Detectives are still investigating the case.

The fact that the trespasser made a grab for the gun AFTER he was shot twice, and in the presence of police, is fatal to his argument that he didn't pose that much of a threat and wasn't looking for a fight.
