    Default FFL can only sell/transfer to resident of their state?

    Somehow, I missed when this became law, or I am misunderstanding the law?

    I guess it's been about ten years ago, I purchased a '73 Colt SAA clone from an Arizona outfit, having it sent to an FFL local to me.

    Recently I came across an explanation of the law saying an FFL can only sell or transfer a firearm to a resident of the state his/her FFL business is physically located.

    A few years ago I (being a PA resident) dropped in to a NJ gun shop to look around. Never occurred to me that, had I wanted to buy, she couldn't sell to me.

    Is the Arizona internet purchase I once transacted now prohibited?

    Most of my surplus collection while living in NJ was acquired from PA gun shows, I have also purchased firearms though gun broker auctions from local gun shops in other states either sent directly to me via my C&R license or sent to a local FFL for transfer.

    FFL can sell long gun to any resident as long as laws of both states are observed (i.e. buying from the NJ FFL means you'd need an NJ FPID, and that you'd need to comply with PA laws as well.

    Handguns must be transferred through an FFL of the buyer's state of residence.

    Correct I should have stated that with the only exception if you have a valid 03 C&R and the handgun you are buying is C&R eligible.

    No change, the AZ FFL transferred the Colt to your PA FFL, which is legal (FFL to FFL) and then the PA FFL transferred it to you.

    No, as long as the handgun is sent to a FFL in the buyers state of residence, and the FFL in that state does the proper transfer paperwork, the sale is perfectly legal. What you might be confused about is the wording. A FFL can only sell/transfer a handgun in a face to face transaction, to a person who resides in that state (with exceptions such as active duty military and college students). An FFL can sell a handgun to a person from any other state but the handgun must be shipped to a FFL in that persons state and the buyer then does the paperwork and transfer at his FFL in his home state.

    If I read things right, they would have to send the handgun to Pennsylvania. You can buy a longarm there and possibly spend twice the amount on an NICS check that would be spent on a PICS check.

    Back in the day, the regulation was that FFLs could sell long guns from directly on-site to residents of their own state, or residents of contiguous states. Handguns directly to residents only, or shipped to an FFL of the customer's choice in any other state.

    The Firearms Owners Protection Act of 1986 permitted direct sale of long guns on-site to residents of the FFL's state, and any other state. Handgun sale restrictions remained as-is.

    Today. there are "old-time" FFLs who still believe that they cannot sell long guns to residents of non-contiguous states. Not true, but any FFL can refuse any sale.
