    A person entering into a casino contrary to posted conditions of entry is arguably engaged in criminal defiant trespass and/or has no right to be there. In either case they could not avail themselves of the protection under the Stand Your Ground statute.

    18 Pa CSA 505(b)(2.3) An actor who is not engaged in a criminal activity, who is not in illegal possession of a firearm and who is attacked in any place where the actor would have a duty to retreat under paragraph (2)(ii) has no duty to retreat and has the right to stand his ground and use force, including deadly force, if:

    (i) the actor has a right to be in the place where he was attacked

    Wouldn't it have to be posted every 20' with the owner's name and address on the posting and each one signed by the owner in black ink in order for it to be enforceable?

    So, virtually all NO GUNS posted on entryway only is unenforceable?

    I've often wondered what a judge would do if the defendant testified under oath that s/he did not see the (one) sign.

    Sometimes the best defense tactic is the defendant does not take the stand. In that case, how does the claim get in?

    The onus being on the prosecution to prove defendant did receive notice would seem the case, but I can see a judge ruling the notice was given, we are not here to determine that the notice was sufficient, and the court does not credit defendant's testimony regarding the notice.

    Ask the testifying petitioner if it's possible that the defendant was looking at the chick in the short shorts and missed the sign. Regardless of how said petitioner answers the seed has been planted and now there is reasonable doubt.

    The statue provides no measurements. Only that the:

    (ii) *posting in a manner prescribed by law or reasonably likely to come to the attention of intruders
    Every casino I've been have posted notices of a plethora of conditions of entry and rules of conduct on placards in the entrance foyers. Whether the size and position of the NOTICE comforts with the "likely ... attention" is a subject call by the trier of fact.

    I always carry at the casino. Nobody has ever noticed. I don't even know if there was a sign or not.
