    Default Are DMV buildings gun free zones?

    I need to go with the wife to renew her driver license next week in Honesdale PA. The DMV is in a rural part of town. I have my LTCF, can I carry my firearm into the DMV or do I have to leave it in the car?

    I’m going to cut and paste my previous response:

    The vast majority of leased Pendot space is illegally posted. I got involved a few years ago and filed some FOIA requests as well as sent letters to Pendot and their lawyers. They tried to claim the property owners posted the buildings, but my FOIA information showed property owners were only asked if Pendot could post the buildings. Furthermore, Pendot bought and provided the stickers. In some of the strip malls (one owner), you would see Pendot posted while six or eight other businesses were not.

    With a anti-gun governor and his buttboy AG in charge, it isn’t worth fighting (yet). IANAL, but if anyone gets confronted, one could certainly stand their ground and ask to get trespassed by the Pendot manager. Video tape the whole thing, and be sure to remind Pendot, and the police, on camera that they are violating PA pre-emption law, and that Pendot has no immunity for violating your rights under color of law.

    IANAL but I am 99% sure you can legally go into any PennDOT CC with a LTCF or OC because of 18 PA 6120 Preemption
    PennDOT is not allowed, by law, to make any rules or laws about firearms that apply to the public. And NO WHERE in PA firearms laws does it say you cannot go into a PennDOT office with a firearm

    My nearest PennDOT Drivers License Center (there's no such thing as DMV in Pennsylvania), located in Indiana, is posted, but it's inside the Indiana Mall, which has some no gun crap posted in small print on some notice off to the side inside the mall.

    My next nearest one, located in Punxsutawney, may possibly be posted, but it's accessible from the parking lot.

    In the past I've ignored both prohibitions. Not sure if I open carried or not, but I certainly didn't not carry.

    I'm not advocating breaking any laws no matter how illegal they may be, however concealed means concealed.

    Was in one just yesterday. It had a no firearms symbol on the door. (Red circle with handgun and slash). No metal detectors.

    Lookie what I saw today.



    This is a brand new location that opened up beside Harbor Freight at East Town Mall. Notice the stickers? There's no way they can claim the landlord did it because none of the other stores in the mall have them, and they weren't on those doors when it was a seasonal shop. There's a OTB on the other side of HF and they don't even have stickers.
