Man dies after being fatally shot testing ‘21-foot rule'
By: Jared Leone, Cox Media Group National Content Desk

    Updated: Mar 23, 2019 - 10:15 PM
AUGUSTA, Ga. - A Georgia man was fatally shot after debating the 21-foot rule, a self-defense tactic, investigators said.

Richard Splichal, 34, and Spencer Warren, 29, were debating how close Splichal could get to Warren before Warren could fire his gun under conditions of the Tueller Drill, which says it takes 1.5 seconds for an attacker to cover 21 feet, the same amount of time it takes to draw and fire a weapon.

When Splichal came toward Warren, Warren fired his .357 revolver twice, striking Splichal once in the chest, WFXG reported.

Warren was arrested and charged with involuntary manslaughter and possession of a firearm during the commission of a crime, WFXG reported.

Is it a crime to 'test' a rule?

Darwin rule seems to work just fine and it supersedes the 21 foot rule

If we assume this is a legit accident, and that is a pretty big 'if', then it reinforces the need to ritualize clearing procedures.
Though I suspect drugs or alcohol were probably involved, or this was a straight up murder.

Investigators: Augusta man killed while testing ‘21-foot rule’

    By J. Bryan Randall | March 18, 2019 at 6:49 PM EST - Updated March 21 at 11:57 AM

AUGUSTA, GA (WFXG) - We now have more information about the events leading up to the death of an Augusta Man.

Just before 10 a.m. on Mar. 16, the Richmond County Sheriff’s Office was called out to the Harrisburg neighborhood for a reported gunshot wound. When they arrived, deputies found Richard Splichal suffering from a gunshot wound. He was taken to Augusta University Medical Center, where he was pronounced dead.

Spencer Warren told investigators he and Splichal has been debating the “21-foot rule” and were going to see how close Splichal could get to Warren before Warren could fire his gun. Warren says he emptied his .357 revolver but did not fully clear it. When Splichal lunged toward him to test the theory, Warren squeezed the trigger twice, firing 1 round into Splichal’s chest.

Warren was arrested and charged with involuntary manslaughter and possession of a firearm during the commission of a crime.

How do you empty the cylinder of a revolver, AND NOT clear one round?

By not fully opening the cylinder and having one round catch on the frame when you just upend the revolver instead of hitting the ejector.
That's why we train people to lock the cylinder open to full extension and smack the ejector rod whether the rounds fall clear or not.

Untrained people like to swing the cylinder open and fling the casings instead of hitting the ejector.
I've seen it done and fail to fully clear the cylinder many times.
Always an important teaching moment on the range.
