    Probably, but I would do a quick assessment then engage them to get a feeling on the urgency of the situation. He said 2 cars in the lot when he left and I would hope he noted that there were 2 when he got there.

    Are there still Blair Witch style rock piles near the reservoir shore? I haven't been on those trails for awhile, but there were 20-30 of them last time I was there. That was pretty creepy.

    In PA there is no disparity of force. If the person(s) attacking you do not display a deadly weapon; you are in deep legal do-do if you use your weapon to defend yourself.

    A friend's client was attacked in the parking lot of his business.
    The three thugs who attacked the client had criminal records, were much larger, younger, better shape, knocked him to the ground, AND said they were going to harm the client.
    The client pulled his gun and did not fire it; because that was enough to scare off the thugs.
    BUT client is still being criminally charged by DA.

    Rather be tried by 12 than carried by 6.
    At least I still would have a chance at seeing my wife and daughter again.

    The problem isn't the victim it's the DA.

    Ok so I am confused on this - if he scared the thugs off, who is charging him and why?

    How did the DA find out about the attack? The victim didn't report it did he? He better hope for jury nullification.

    It still sucks that he has to be judged by 12 in that situation.
