    Police say a 26-year-old man falsely claimed having no criminal record in order to buy a gun.

    Moises Saldana, of the 100 block of Chestnut Street, was arraigned Thursday on charges, placed in Lehigh County Jail, with bail set at $5,000, and is awaiting a district court hearing.

    A police affidavit states the following:

    Saldana pleaded guilty to a felony burglary charge in 2010.

    Yet, he answered “no,” when filling out a form asking if he had ever been convicted of a crime, in order to buy a gun at an Upper Macungie Township store in September 2017. The form clearly states people aren’t allowed to own guns if answering “yes” to this question.

    Gun purchase applications are sent to state police for criminal background checks, a process that usually takes months.

    In this case, state police contacted Upper Macungie Township police in January 2018, after checking Saldana’s background and learning he’s prohibited from owning any guns due to his criminal conviction on the 2010 burglary charge.
    Authorities have not said why Saldana wasn’t charged until Thursday in the illegal attempt to buy a gun

    Why wasn't he stopped at point of purchase? What happened to PICS?

    That was my immediate question, he should have been denied right then and there. And if PICS was down for some reason, the FFL should not have allowed the firearm to leave with the buyer. I wonder if the PSP asked the dealer any questions???

    Why hasn't he been charged on the federal level either? It's the job of the feds to follow up on every one of these and more often then not due to limited resources.

    If he is safe enough to be loose in society, he is safe enough to own guns....just sayin.

    OK, upon deeper thought I don't see where he successfully bought it, the article talks about trying, not managing to get one.

    I agree but I look at it from a different angle...if he's not safe enough to own guns he shouldn't be allowed loose on the streets.
