EM, there is actually no rule or law about possessing a pistol upper without a lower, but as said, if someone told the ATF that you had one and had multiple AR lowers that it could fit on then the ATF could stop by and ask what is going on and if they really wanted to be a**holes they could bring charges using the constructive intent argument. I would think though that if that person was a heretofore law abiding person and had a good gun lawyer, it probably wouldn't get very far (just my opinion and I don't wear a tin foil hat).
