    Default Open Carry State Park

    I have read multiple threads about this and believe I understand... but I don't fully understand...

    PA State Park
    Handgun
    Possess a valid LTCF

    I know with almost complete certainty that I can conceal carry, but I am unsure if I can open carry.

    The threads I read appear old and there was some confusion if one could open carry, can someone fill me in I would appreciate it.

    You can not open carry. Concealed carry is good to go.

    This subject has come up several times. It appears to be a preemption violation if you were to get arrested. If I were you I wouldn't want to find out. Some park rangers may push the issue and other may not care one bit. IANAL

    Disagree. The licensing statute (6109) had a tweak that basically put preemption controls on all "Commonwealth Agencies". This would apply to DCNR (and DMV offices too). Reps in Harrisburg agree. Big shots in various agencies do not (go figure).

    To this date, I'm unaware of anyone who has pushed the issue enough to be cited, thus the courts have yet to weigh in.

    (m.3) Construction.--Nothing in this section shall be construed to:

    (1) Permit the hunting or harvesting of any wildlife with a firearm or ammunition not otherwise permitted by 34 Pa.C.S. (relating to game).

    (2) Authorize any Commonwealth agency to regulate the possession of firearms in any manner inconsistent with the provisions of this title.

    I at least now understand why there is some confusion.. I am all for gun rights but not planning to start out 2019 as a test case.. lol

    If an agency just wants to make you and your family go broke the administrative state may violate the law until the very last appeal so that you and your family are starving and homeless on the street defending yourself just because they can. Laws are made for the citizens to obey the administrative state is exempt.

    I was referring to overturning the State Park's banning carrying in the parks but going to jail was due to her own doings.
