    Default Can I

    Came out side in tje middle of the night to smoke a cigarette. Then saw a person in my car. I ran inside to grab my firearm. When I came out the intruder was walking around the corner. My question is could I have shot him while in my car? I know i couldn't shoot him while leaving or not posing a threat.

    Well you could but it would get you jail time, this ain’t Texas. You can’t use a gun to protect property in pa. Ianal

    No.

    The only times you can use deadly force in PA are:

    1. To protect yourself from death, serious bodily injury, rape, or kidnapping.
    2. To protect a 3rd person from the same above.
    3. To stop a forcible type felony as enumerated in Chermansky case.
    4. To stop a fleeing felon of a forcible felony as enumerated in the Chermansky case after you announce your intent to arrest them, and the arrest cannot be immediately effected.
    5. When someone has unlawfully intruded into the dwelling that you are habituating.
    6. When someone has unlawfully intruded into the vehicle that you are currently in.
    7. When you are in your place of business and someone has unlawfully intruded.
    8. When authorities have given rioters a lawful command to disperse and they do not.

    What Knight0334 said. If you shot someone in your car when your life was not in danger you would have severe legal repercussions for doing so.

    Wait, what?
    So if I happen to be in the vicinity of one of those Antifa riots, I hear the cops order them to disperse and they do not. Does that mean I can just pull my piece and empty the mag into the crowd of commies?

    Since the car was not in any mortal danger, no.
