    Just spit balling here, but I'm guessing that what he wants is to wake up in the morning and have a car that he can drive to work.

    Bullet-smashed window(s) or windshield, blood inside the car, car impounded by police taken as evidence, make bail in time to drive to work without the car....I don't think that would work.

    Needed for the thread: Pennsylvania rule/description of "forcible felony". Attempts to look up revert to use of force in arrest of a person who committed a forcible felony, but no explanation of forcible felony. Last I knew, Penna had crimes against person and crimes against property.

    Entering a parked and locked vehicle involves force, but not the kind of force that places anyone in danger of serious bodily harm or death, and would be crime against property. Unless the charge has been altered, burglary of railroad car would be the charge (yeah, I know...I made a commonwealth court judge surprised at that one).

    Confronting runs the risk of escalation at which the BG whips out a weapon, and now you do have a crime against person felony. Problem is, it may be argued that breaking into an unoccupied vehicle is tampering or attempted unauthorized use, no way to prove a more serious grading of theft. Not worth it.

    plus if the perp then attacked him, he wouldn't have a self defense case when they question those marks on the living or dead perp's shins.

    best to just not keep valuables in your car, keep good insurance and keep it locked.
    as a matter of fact, keep your car full of empty cans and trash and it'll never be broken in to. i know none of mine ever have.
    always forget to throw a little trash bag in there so the floor basically gets covered.
    oh and don't drive something people want to steal, drive a ford, they know they'll break down before the cops even have to chase them.
