They can't. This is going to get smacked down in the courts.
Bureaucrats can't create law, they can just apply the laws that delegated to them by the legislature.
ATF has to define machine gun and what constitutes one based on NFA34 and its amendments. That's why they were legal, because the ATF applied the regulation correctly the first time.
This time the ruling is wrong, based on the plain language of the law on how a machine gun is defined.
If the judge that sees this is actually there to enforce the law, it'll get thrown out on day 1. If Congress wants to define a bumpstock as a machine gun, they're going to have to change the law before ATF can promulgate the rule.

Of course- the NRA are the ones that called for additional regulations (their words, not mine).
The NRA believes that devices designed to allow semi-automatic rifles to function like fully-automatic rifles should be subject to additional regulations.

Ashamed for voting for this guy, aside from the SC nominations. Hopefully this gets knocked down, but history says not to hold my breath.

During a meeting with lawmakers at the White House on Feb. 28, President Trump suggested to “take the guns first, go through due process second” in the cases of people who are reported as dangerous.
Guess you could say that in 90 days from now, those who havent destroyed or turned in their bumpstocks will be reported as "dangerous". Cant wait til the NYvalues decides that having a mag greater than 10 rounds or an evil semiauto rifle makes us reportable as "dangerous".Hold the Line...
