The biggest problem this will create, and I’m assuming the reason for preemption in the first place, is the way this stupid state is divided up into a million little fiefdoms, with a new one starting every 17 feet or so, you’ll never know what the laws are as you move around the state, and whether you’re breaking one at any given time.

Wait until 2019 when it is reintroduced. There will be more democrats in the state congress this year, but they are still in the minority. Probably will not get out of the committee. Even if democrats controlled the state legislature, and even if the bill passed, there would be strict limitations as to how intrusive their ordinances could go. The Pa. crimes code does not identify the chapter on gun laws as the uniform firearms act for nothing.

How does PA UFA figure into this? Ufa is separate from the crimes code, correct? So wouldn't it have to be amended as well for this to have legal bearing?

UFA is part of the crimes code and it incorporated in a particular chapter. This proposed legislation would nullify the word uniform, but current state law would still be in effect. This legislation would permit localities to pass their own ordinances within limits. What limits will be hotly contested.

I find the proposed legislation very vague in their narrative to "balance second amendment rights with community concerns........."

I emailed FOAC about this and received the following response from Kim Stolfer:

Thank you! There is an ALL OUT assault on Preemption brewing and my contacts tell me that a package of local gun control bills will be released on December 14th.

FOAC is preparing to file a lawsuit against the City of Pittsburgh and we could certainly appreciate any donations to help us deal with these legal costs. Right now the Preemption precedential court case is FOAC vs. Lower Merion Twp. and if the City of Pittsburgh would succeed their action would overturn the Ortiz Decision (1996) and Lower Merion Twp. (2016).

ALL monies collected will be dedicated funds to this lawsuit and we are committed to taking this matter to the Supreme Court if necessary but we ‘need’ some help if we are to be successful.

Thank you for sending this link and ‘yes’ I did have this memo already and Frankel is an anti-gun putz!

Thank you VERY much for thinking of us!!
Please consider donating to FOAC. they are a great gun rights group for PA, and are consistently on the front lines.
