I thought I read that charges won't even be considered until the law goes into effect.

The violation isn't the effective date of the ordinance, the violation is the passing of the ordinance.

They're still trying, if nothing else to make a statement. News likely present.

STATEMENT OF THE OFFICE OF THE DISTRICT ATTORNEY
CONCERNING RECENTLY SIGNED CITY OF PITTSBURGH GUN

    LEGISLATION

The Office of The District Attorney cannot legally approve
any private criminal complaints concerning legislation that has not
yet taken effect. The gun legislation recently passed in the City of
Pittsburgh has three components with two different effective
dates. The first two scheduled to take effect 60 days from April 9,
2019 and the third, 120 days from April 9, 2019.

Therefore, the office will not be considering any such
complaints until such time as someone is legally cited."

My email to them, please note some very specific buzz words that should make them nervous:

Since your office has previously stated these actions to be unlawful, the actual charging of individuals and timing of the laws going into effect is immaterial. From the official response, I can see the "Just US" system has spoken, I take it that effectively means we are now acting without rule of law.

My guess is that the Harrisburg case was started long before the decision on Lower Merion. Can't really give a definitive answer

So it appears, according to the DA, that there is no preemption violation until Pittsburgh enforces the illegal laws. That make a mockery of preemption. This is why the elites cannot be trusted. They cover and protect each other against the citizens that are they are paid to represent and serve. Just another sign of tyranny.

So instead of preventing injustice suffered from the illegal laws, the DA demands that people be actually harmed before he enforces (maybe) the pre-emption law?

Even when someone is harmed by the illegal law he won't do anything. He'll leave it up to the victim to sue the city council.

I have always suspected that would be the case, but this is pretty brazen. He is saying he won't take any complaints until the City brings charges against the citizens. Guess then he will be too busy helping the city to enforce the illegal laws against citizens to enforce the law against the city. Catch 22.

DA Zappala will claim prosecutorial discretion. IMO he should be impeached.

Rep Metcalfe is preparing an impeachment filing on Peduto. Maybe he'll do one for Zappala too.
