    Any claim of self defense by definition affirms it was a deliberate act. That is why tradional insurance will not cover it. Then you go about persuading the DA, jury, counsel/pickpocket for the injured/deceased yute or his family, that the guy needed shooting. He put you in great and reasonable fear for your safety/health/ life and you shot only as much as you perceived as being necessary to stop the threat. It is nice to have at least one round left in the gun, if possible, as evidence of your restraint. Getting in early with legal and expert representation can short stop the process and save a ton of money. Gerald Ung was an interesting case where his parents' home owners insurance was forced to represent him. The complaint said he did a number of negligent acts (took a gun with him to a bar etc). Negligent acts fell under the available insurance and it paid for Ung's representation (and gave potential access to the insuror's deep pockets for the complainant). I think the civil actions are continuing.

    Deliberate implies an unhasty preparation. I think there are two separate acts in shooting to stop a threat.

    The first is the decision to enhance one's right to life and freedom from injury for himself/herself and certain others by carrying a gun.

    The second is the decision that a situation warrants employment of the gun.

    In the first, the carrier is in control. In the second, the attacker is in control and assuming the risk of being repelled.

    I do not see where the first transfers onto the second.

    I built a Roo guard for the front of my little 4WD.

    Worked.

    Haven't hit a single kangaroo.

    Saved the fenders when I hit a deer, too.

    And for anyone with serious time on their hands with nothing to do but read how complicated self-defense cases can get, the following cite gives ample evidence of it. Note particularly that the incident leading to all this drama took place 12Dec2015, almost three years ago. I can only speculate as to the $ involved on behalf of presenting the Defendant's argument.

    The Commonwealth appealed the trial court's finding to the PA Superior Court. All that was on the taxpayers. But, yes, the drawn-out procedures are frustrating and scary.

    I think the trial judge in preliminaries tried not to waste his court's (and everyone's) time on attempted murder, knowing from experience a jury would find attempted murder not guilty.

    I had a case where defendant stabbed a retreating victim several times in the back and the jury rejected attempted murder (probably because the victim lived). Can't get much purer in intent than that.

    Yeah...a tough one for sure. I want to stop a guy "just right". Not too much as if it looks like overkill, but at the same time, not so little that he...well...kills me. Yeah. Tough one.

    I will lean towards stopping the fight every time. Put whatever label on that you wish. I didn't go looking for a fight anymore than I went seeking to total my truck.

    If I'm in court, I survived to that point to be able to tell my side of it.

    I signed up for CCW Safe. I don't intend to ever use it. I hope to God I don't need to. But let me explain why I have it.

    I carry pretty much every day, and in every state that I travel to that has reciprocity with PA, FL, UT and AZ. What kept me up at night was the fear of having to shoot someone in Bumfuk, VA at three in the morning and knowing that I will be much better with off a lawyer answering questions then me standing there dazed after I just peed my pants. I don't know a lawyer here at home, much less anywhere else in the country.

    I got the insurance for one reason - that 800 number on the back of the card. The one number I can call and then shut up. No matter where or what time of night. It's definitely worth the $12 or so a month.
