    Wrong, wrong, wrong, and false. You can absolutely gift a firearm to anyone, so long as you are not aware that they are a prohibited person. You must transfer it to them via an FFL (in their home state if it's a handgun, and they are not a PA resident), but it can without a doubt, be a gift.

    Whether the transaction involves formal paperwork (or not) has zero bearing on if it is a gift or not.

    Also, since the girlfriend has an LTCF, you can actually let her unwrap it as a gift, and explain that she is 'borrowing' your handgun until you can complete the gifting transaction with the necessary paperwork.

    In Pennsylvania a real pistol must be registered to her and she has to be approved by the Federal and State governments to possess it. You cannot give her a real pistol that you bought, that is not approved by the government and you could be considered a straw buyer if you don't follow all the Federal and State regulations. You can wrap up a practice blue gun so she has something to unwrap on Christmas morning but then in order for her to get the real thing she has to go to the government approved retailer and get the Federal and State government's approval in order to get a real pistol. A second and more complicated way is you could always make her an honest woman and forgo all the traveling to a government approved firearms retailer.

    That's NOT what the form asks. It asks "Are you the actual transferee/buyer of the firearm(s) listed on this form?"

    You ARE the actual buyer, if you're buying the item as a gift for someone else. (IE using YOUR money to purchase them a gift). You're NOT the actual buyer, if you're using their money to buy it because they can't pass a background check.

    They explain this on page 4 of the 4473.
