There's enough blame to share with Congress on this one. The SBR parts of the NFA have made no sense for 84 years.

This kinda went down how I predicted, in another thread we had regarding SB Tactical's SBA3 brace and how they are counting on prior approvals to apply to that product, despite the letters say explicitly that it would not apply to any modifications applied to the approved brace.

A documented opinion from the ATF is the only way I would ever own a brace. There will never be 100% alignment across all branches/offices of the ATF, so you're really at the mercy of the local office/DA on whether they want to prosecute or not. Innocent before proven guilty doesn't include the court process itself; the bail money (and if he used a bondsman, 10% bail out of pocket), time spent in court/jail, loss of pay/job, etc. is not worth having a cane tip on your brace.

Do your homework, keep documentation, and keep up with the changing view of the ATF as they try to make sense of laws that make no sense. In the end, it's what you can prove, not what you believe.

Right, but how did he get caught in the first place? Was he blabbing about his rubber thingie online, or did somebody rat him out at the range?

I had an Anderson lower and picked up the kit for $289(free shipping) from PSA. It was a complete kit sans the lower and optic.

TTAG had more information posted on their blog:

Toledo police responded to a domestic disturbance call in March at the home of Kelland and Christina Wright. Mr. Wright, a Marine veteran, allegedly threw a cell phone at his wife and was arrested. As a part of an arrest for a domestic violence complaint, police confiscated all firearms in the home, including an AR pistol equipped with the Maxim cheek rest.
