Dramatic footage of a fatal shooting of a man that stemmed from a heated argument with his father-and-son neighbors over where to dump a mattress has emerged.

A West Texas man was shot and killed on September 1 and a father and son have been arrested on murder charges over what a police chief calls a neighborhood dispute about trash.

Police responded to calls about shots fired around 10.15 a.m. and located the victim, 37-year-old Aaron Howard, who died at a hospital.

John Miller, 67, and 31-year-old Michael Miller were arrested on murder charges over the death of Howard.

Howard was shot dead as his brother and fiancee witnessed the horrific incident first-hand, according to the Star-Telegram.

All three are idiots, who in there right mind stands and confronts two jackasses over a dam mattress at dumpster. It's just plain stupid to stand there and argue with two idiots with firearms in their hands. Smart person retreats and calls local law enforcement. Why stand there telling them to put their guns down so you can kick their asses , none of what happened is logical all three involved where stupid. I would expect that this does not end well for the shooters, no doubt he would most likely kicked their asses had they put their guns down . And what's up with the idiot handing him a bat to use against two guys with guns. Video was interesting and it shows that everyone is always filming ,something else you have to consider when using a firearm,you had better be on the right side of the law.

That bat might get the shooters off. A big enraged man repeatedly saying he will kick your ass and threatening to kill you. Picking up a bat while he is next to you is not exactly "unarmed".

I agree they should have been arrested but this one is up to the jury. No sympathies either way. There is more than enough fail to go around.

It also appears the dad was hit with the thrown baseball bat after he started shooting at the guy. Junior only started shooting after his dad was hit.
