    An illegal immigrant shoots a handgun on a NYC sidewalk in a gang dustup. The shooter claims he has Second Amendment rights and can't be prosecuted for possession of the firearm.

    Leftist New York courts may have to decide: Do we love illegal immigrants more than we hate the Second Amendment? What is a liberal to do?

    Illegals dont have rights (or shouldn't) but than again,
    they have more rights than legals.

    Illegal immigrants, as all humans, have rights, because unalienable rights (some of which are listed in the Bill of Rights) are endowed by God, and are only enumerated by the United States Constitution. These rights would be theirs regardless of place of origin or current location. Whether any government recognizes these unalienable rights is a different question, as is whether or not the illegal immigrant has the privileges of American citizenship. I think we can agree that illegal immigrants should not have the privileges of American citizenship, as they are not American citizens; however, to say they do not have rights is to undermine the entirety of the Declaration of Independence.

    Side note: If this guy wins, and I get pinched in NYC with a gun, I'm just going to tell them I'm an illegal in a sanctuary city, and go about doing whatever I want. That's the way it works, right?

    I thought they didn't arrest illegals. They should just let him go before evil ICE shows up and deports him.

    Is the ACLU taking up the case? Seems as though that's the only time they care about defending gun rights is when it's an actual criminal.

    If they *only* thing they can charge him with is the "possession" of the gun, then I'm on his side. The Constitution doesn't grant rights, it recognizes them. Self-defense in a natural right for all. Cut him loose and deport immediately for being here illegally.

    If there was other behavior that warrants criminal charges, that would apply to a citizen too (gang shootout, careless discharge, etc.), then he should be tried, and if found guilty, expeditiously deported.

    Federal courts have in the past validate they have 1st and 4th rights.. hmmmmm

    Because there is no allegiance to our flag, laws and government, any illegal sneaking in this country should be considered as an enemy of the U.S.A, and a threat to our citizens, and local, federal government. By there deceitful entry they are untrustworthy, devious and potentially harmful.

    They must be immediately removed out of the country.
