    Default A bit of fail in this self defense situation

    Sounds like a guy defended himself shooting his assailant in the arm. Then threw the gun to the side and wrestled him to the ground and pinned him. But the other person had a friend who picked up the gun and took control of the situation.
    It worked out for the citizen, but not the smartest thing to do imo.

    POCATELLO MAN ARRESTED AFTER BEING SHOT BY HIS NEIGHBOR

    POCATELLO -- The man who was shot by his neighbor on the city's west side Saturday night ended up being the one going to jail for the incident.

    Police said they arrested Bryan Huff, 29, of Pocatello, after he was released from Portneuf Medical Center early Sunday morning. Huff was treated at PMC for the gunshot wound to the arm he received in the 1000 block of West Clark Street during a dispute with a neighbor around 9:40 p.m. Saturday.

    Huff has been booked into Bannock County Jail on a charge of felony aggravated battery for allegedly running at his neighbor while armed with a steel pipe in the neighbor's yard, police said.

    The neighbor fired a pistol twice at Huff in self-defense and one of the shots hit Huff in the arm, police said.

    The man who shot Huff threw the gun after opening fire and Huff and him then became engaged in a fistfight which ended with the man pinning Huff to the ground, police said.

    While the man and Huff were fighting, a female friend of Huff's retrieved the pistol. She then pointed the gun at the man and ordered him to release the pinned Huff, police said.

    The man complied and everyone returned to their respective houses and dialed 911.

    They weren't the only ones calling the police.

    Pocatello police said they received dozens of phone calls reporting the shooting.

    Police had actually responded to a shouting match between Huff and the same neighbor earlier on Saturday. Police said they separated the two following that incident and ordered them not to communicate with each other for the rest of the day but obviously that didn't happen.

    The subsequent Saturday night confrontation began with Huff and the neighbor yelling at each other. Then others from both households joined in the shouting match and shortly thereafter Huff allegedly grabbed the steel pipe and charged at the man, police said.

    When police arrived, they quickly located the wounded Huff as well as the man who shot him. Huff was transported to PMC via a Pocatello Fire Department ambulance and police began interviewing everyone involved in the incident to piece together what happened.

    If convicted of felony aggravated battery, Huff faces a maximum penalty of five years in prison and a $5,000 fine.

    Police said they aren't sure what triggered Saturday's confrontations between Huff and his neighbor but one witness said the disagreement started over a dog that belongs to one of the men.

    The name of the man who shot Huff has not yet been released and police said he will not be charged with a crime because he was defending himself on his own property.

    OMG IDK how some people remember to breath somedays. The good guy GG is lucky he didn't get killed with his own gun. The bad guy BG is also lucky he didn't get killed. Why wasn't the woman charged? IMO she should also be charged. GG needs some training no make that lots and lots of training.

    As bad as the car jack victims who pointed a firearm at the perp who ran to the next car and slashed the driver who pointed a firearm at the perp, who ran for a 3rd car but was luckily stopped by the police.

    I question why neither victim 1 or 2 took a shot?
    with victim 1 she broke free and grabbed her handgun from the trunk
    victim 2 the perp jumped in the passenger side and cut the driver

    Sounds like these guys need to spend a couple nights at the Days Inn Hotel in Bend, Oregon with one Robert Garris.
